HomeMy WebLinkAbout10802ORDINANCE NO. 10802 AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE APPROXIMATELY 1.4-ACRES LOCATED AT 1003 LIBERTY LANE FROM R-1, SINGLE-FAMILY ZONE DISTRICT TO R-5, MIXED RESIDENTIAL AND OFFICE ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from R-1, Single-Family Residential Zone District to R-5, Mixed Residential and Office Zone District: LOTS 18 TO 26 INCLUSIVE, BLOCK 27, BELMONT 11TH, AND A PORTION OF VACANT STREET ADJACENT TO LOT 18 TO 21, LESS TRACT IN #445204 (NOW BELMONT 11TH RE-PLAT) ALSO LESS 0.18 ACRES OUT OF A PORTION OF LOTS 20 & 21 TO CHAMPION HOMES OF PUEBLO INC. BY DEED #48909 SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Ordinance re-adopted on a vote of ____________, on _____________ ____________________________ President of City Council ATTEST ________________________________ City Clerk City Clerk's Office Item # S2 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: September 23, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE APPROXIMATELY 1.4-ACRES LOCATED AT 1003 LIBERTY LANE FROM R-1, SINGLE-FAMILY ZONE DISTRICT TO R-5, MIXED RESIDENTIAL AND OFFICE ZONE DISTRICT SUMMARY: The applicant is requesting to rezone approximately 1.4-acres from R-1, Single-Family Residential Zone District to R-5, Mixed Residential and Office Zone District to facilitate the development of two affordable multifamily residential structures and repurpose the existing church as a leasing office and community clubhouse. PREVIOUS COUNCIL ACTION: The applicant is concurrently requesting amend the Pueblo Regional Comprehensive eighborhood (CP-24-01). BACKGROUND: Archway Communities owns the property located at 1003 Liberty Lane and they plan to develop two multifamily residential structures along the northern and western property lines and preserve the existing church, which is centrally located on the site. The subject site is located adjacent to the east side of Bonforte Boulevard, which is and Design Standards, a minor arterial roadway provides for high-capacity traffic and th-use development is appropriate adjacent to a minor arterial roadway. Commercial and professional offices exist to the north, east, west, and south of the site. Three-story multifamily residential uses are located to the northwest of the site, and one single- family residential structure sits adjacent to the southeast corner of the site. The surrounding neighborhood is considered a mixed-use neighborhood containing a mixture of multifamily residential uses, non-residential uses, and one single-family residential use in the immediate neighborhood. Due to its location and surrounding development, the R-1 zoning appears to be unsuitable and detrimental to future redevelopment efforts of this site. Rezoning to an R-5 Zone District will facilitate the development of two, three-story multifamily residential structures, containing a combined total of 24 one- and two-bedroom dwelling units for households that earn 30- 80 percent Area Median Income (AMI). The applicants intend to repurpose the services, which will bring life back to a site that has fallen into disrepair since the closure of the Christ Congregational Church. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their August 14, 2024 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
