AN ORDINANCE APPROVING AN AGREEMENT TO
PURCHASE AND SALE OF REAL ESTATE BETWEEN THE
BISHOP OF PUEBLO, A CORPORATION SOLE, AND THE CITY
OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, FOR
THE PURCHASE OF EASTWOOD SUBDIVISION BLOCKS 28
AND 33 REARRANGMENT OF PROPERTY BOUNDARIES IN
THE AMOUNT OF $120,000.00 TO BE PAID FROM PROJECT
NO. CI2113 AMERICAN RESCUE PLAN ACT, AS
AUTHORIZED BY SECTION 603(A) OF THE AMERICAN
RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR
35 AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Pueblo, a Municipal Corporation, and The Bishop of Pueblo, a Corporation Sole, attached
hereto, is hereby approved.
SECTION 2.
Funds in the amount of $120,000.00 are hereby authorized for payment from Project No.
CI2113 American Rescue Plan Act, for purposes of purchasing EASTWOOD SUBDIVISION
BLOCKS 28 AND 33 REARRANGMENT OF PROPERTY BOUNDARIES.
SECTION 3.
After the Agreement is approved as to form by the Department of Law, the Mayor is
hereby authorized to execute said Agreement for and on behalf of the City and the City Clerk is
authorized to affix the seal of the City thereto and attest the same.
SECTION 4.
The officers and staff of the City are hereby authorized to perform any and all acts
consistent with the intent of this Ordinance and the attached Agreement to effectuate the
transactions described therein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Ordinance approves an agreement for the purchase and sale of EASTWOOD
SUBDIVISION BLOCKS 28 AND 33 REARRANGMENT OF PROPERTY
BOUNDARIES from The Bishop of Pueblo to the City of Pueblo and authorizes the
acquisition.
PREVIOUS COUNCIL ACTION:
On May 17, 2021, City Council approved Ordinance No. 9931, which established
Project No. CI2113 and budgeted and appropriated up to $36.7 million in funds which
were expected to be distributed to the City from the American Recovery Plan Act
which began on March 3, 2021, until December 31, 2024, to be expended by December
31, 2026.
On February 12, 2024, City Council approved Resolution No. 15498, which authorized
payment of $180,000.00 from Project No. CI2113 American Rescue Plan Act, for the

purposes of purchasing the property known as 2701 East 12 Street, Pueblo, CO,
performing certain property boundary changes, performing certain improvements, and
authorizing the Mayor to execute any required documents.
BACKGROUND:
The City of Pueblo and the Diocese of Pueblo entered into a Lease Agreement in
January 2004 for a five-year period ending December 31, 2008, for use of the area

Street) as a recreation area, park, and
playground. The park includes a softball field, restroom, and a playground. The City
constructed additional improvements at the park in 2016 and 2017 with Community
Development Block Grant Funds from the U.S. Department of Housing and Urban
Development, further requiring the public improvements to be dedicated to a public
purpose through 2028.
On January 1, 2018, the terms of the Lease allowed for automatic month-to-month
Amendment No. 2 was approved on February 17, 2023, which extended the Lease
Agreement until such time as the real property could be sold to the City, but no later
than December 31, 2023.
FINANCIAL IMPLICATIONS:
2024 at a cost of approximately $24,000. The appraised property value for the
subdivided property was estimated at $140,000. Diocese has agreed to sell the City the
property for $120,000, but the City is required to install a fence along the new property
boundary and adjust the irrigation and electrical systems.

ALTERNATIVES:
The City Council could decide not to purchase the property from the Diocese which
would result in the
