AN ORDINANCE APPROVING A MEMORANDUM OF
UNDERSTANDING BY AND BETWEEN THE CITY OF PUEBLO,
A COLORADO MUNICIPAL CORPORATION AND THE
COLORADO STATE PATROL, "BATTLE", BEATING AUTO
THEFT THROUGH LAW ENFORCEMENT TEAM
WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo,
including its Police Department, to approve Memorandums of Understanding, and to enter into
agreements relating thereto; and
WHEREAS, City Council approved a grant agreement with the statewide Beat Auto
Theft Through Law Enforcement Team (BATTLE) on August 19th, 2024, which awarded an
initial award of $130,000.00.00 in grant funds from the Colorado Auto Theft Prevention Authority
(CATPA) for the 2024 grant year upon conditions recited therein or incorporated therein by
reference; and
WHEREAS, acceptance of the MOU for the purposes for which it has been made is in
the best interest of the City and will benefit the health, welfare and safety of the citizens of the
City; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Memorandum of Understanding, a true copy of which is attached hereto and
incorporated herein, is hereby accepted and approved in accordance with its terms and
conditions.
SECTION 2.
The Memorandum of Understanding, having been approved as to form by the City
Attorney, is hereby approved and accepted. The Mayor is authorized to execute the
Memorandum of Understanding in the name of and on behalf of the City, and the Mayor is
authorized to execute any and all other certifications, assurances and other documents
associated therewith.
SECTION 3.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate the policies and procedures described
herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

STATE PATROL, "BATTLE", BEATING AUTO THEFT THROUGH LAW
ENFORCEMENT TEAM
SUMMARY:
City Council last approved a 3-year MOU with the statewide Beat Auto Theft Through Law
Enforcement Team (BATTLE) on June 28, 2021. The 3-
30, 2024. On July 1, 2024, the Pueblo Police Department was awarded $130,000.00 in
funds for supplies and operating expenses as well as overtime costs associated with auto
theft investigation and enforcement which has already received council approval. Attached
is a Memorandum of Understanding (MOU) that will allow the Police Department to
participate in statewide BATTLE operations. This Ordinance approves the MOU.
PREVIOUS COUNCIL ACTION:
City Council has approved ordinances in the past entering into Memorandums of
Understanding with BATTLE.
BACKGROUND:
Each year since July 2009, the City of Pueblo and Pueblo Police Department have
accepted Colorado auto theft grant funds. The total funds are disbursed by CATPA and
are shared among several different law enforcement agencies in Colorado. An MOU
formalizes the relationship between the various participating agencies.
The BATTLE multi-jurisdictional task force focuses on the prevention and reduction of
motor vehicle thefts as well as the identification, investigation, location of stolen motor
vehicles, and apprehension of suspects. The task force works to increase the number
of stolen vehicles recovered, offenders arrested, and decrease vehicle thefts. The
agencies accomplish this through educational and intelligence-led enforcement efforts
throughout participating jurisdictions with task force members sharing information
amongst each other and any other requesting agency.
FINANCIAL IMPLICATIONS:
The City of Pueblo, Pueblo Police Department, will be reimbursed up to $130,000.00 in
overtime expenses by approving the MOU.

ALTERNATIVES:
City Council may decline the MOU. If that occurs, the Police Department cannot be
reimbursed from CATPA funds for overtime costs and will not be able to participate in
statewide BATTLE operations for this program.
RECOMMENDATION:
The Police Department recommends approval of the Ordinance.
