AN ORDINANCE APPROVING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION, AND THE STATE OF
COLORADO, OFFICE OF PUBLIC SAFETY COMMUNICATIONS
TO CONTINUE THE ESTABLISHED COOPERATIVE
RELATIONSHIP RELATED TO THE CIN
THE STATE DIGITAL TRUNKED RADIO SYSTEM AND THE CO-
LOCATION OF STATE EQUIPMENT INSTALLED ON CITY-
OWNED TOWERS AND FACILITIES, AND AUTHORIZING THE
MAYOR TO EXECUTE SAME
WHEREAS, the City desires to continue its cooperative partnership and co-location of
state-owned equipment on City-owned tower sites and associated facilities.
WHEREAS, it is critical to maintain public safety and non-public safety radio
communications for the safety and preparedness of City and this memorandum of
understanding is intended to maintain communication systems; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Memorandum of Understanding between the City of Pueblo, a Colorado Municipal
Corporation, and the State of Colorado, Office of Public Safety Communications, a copy of
which is attached hereto, having been approved as to form by the City Attorney, is hereby
approved.
SECTION 2.
The Mayor is hereby authorized to execute said Agreement for and on behalf of the City,
where the Mayor may execute the Agreement by electronic signature and such electronic
signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
The officers and staff of the City are authorized to perform all acts consistent with the
intent of this Ordinance to effectuate the transaction described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Ordinance approves the attached Memorandum of Understanding with the State of
the co-location of the State-owned equipment install on the City owned Radio Towers
and associated facilities
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
(DTRS) for our public safety and non-public safety radio communications. The City
departments since 2007 to provide the infrastructure and facilities to support this
system. Upon completion of the ordinance destruction at the Pueblo Chemical Depot,
all core equipment purchased with the Chemical Stockpile Emergency Preparedness
(CSEPP) federal funds, was granted to the State of Colorado, Office of Public Safety
Communications by Pueblo County. However, this equipment remains intact and
located on or within City-owned facilities. The DTRS provides a near seamless
statewide wireless system that enables emergency and operational direct
communications between first responder/public safety agencies across jurisdictional
and regional boundaries. The sharing of communication resources substantially
reduces costs for all participating agencies across the State.
The State is committed to its continued support of the DTRS. This MOU is designed to
continue the established cooperative relationship between the City and the State,
-location of State
equipment installed on three (3) tower sites and within other facilities owned and
operated by the City, as set forth in the attached agreement.
FINANCIAL IMPLICATIONS:
There are no additional costs to the City with respect to this Ordinance. Should the
State of Colorado modify current legislation, additional costs related to the DTRS may
be required. These costs will be presente
process and approved through Council action.

ALTERNATIVES:
If City Council does not approve this Ordinance, the City of Pueblo and the State Office
use of the DTRS system and the co-location of State equipment jeopardizing public
safety interoperability and utilization of the DTRS system with other city departments,
state agencies and participating local, federal, and tribal governmental entities.
RECOMMENDATION:
Approval of the Ordinance.
