HomeMy WebLinkAbout10791ORDINANCE NO. 10791 AN ORDINANCE TRANSFERRING $503,915.07 FROM WW9999 TO WWAN03, FOR PROJECT NO. 20-059 (WWAN03) 2021- 2023 SANITARY SEWER POINT REPAIR - 250 WILLIAM WHITE BLVD PROJECT AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE THE SAME. WHEREAS, the repair work was performed under the Sanitary Sewer Point Repair multi- year contract under which three contractors were qualified via competitive bid. An estimate was prepared, and Parker Excavating was the lowest bidder, but could not perform the work. WHEREAS, Miller Pipeline, LLC (previously known as K.R. Swerdfeger Construction, Inc) of Pueblo, Colorado was the next low bidder and accepted to perform Project No. 20-059 (WWAN03) 2021-2023 Sanitary Sewer Point Repair 250 William White Blvd; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds in the amount of $503,915.07 are hereby transferred from account Project WW9999 into account Project WWAN03, 2021-2023 Sanitary Sewer Point Repair 250 William White Blvd Project, and budgeted and appropriated for project WWAN03. SECTION 2. City Council authorizes Project No. 20-059 (WWAN03) 2021-2023 Sanitary Sewer Point Repair 250 William White Blvd Project, to be performed, and the contract for said project is hereby awarded to said bidder in the amount of $503,915.07. SECTION 3. Funds in the amount of $503,915.07 will be paid from the Sewer User Funds for Project No. 20-059 (WWAN03). SECTION 4. The Mayor is hereby authorized to execute said contract on behalf of Pueblo, a Colorado Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 5. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the contract to implement the transactions described therein. SECTION 6. This Ordinance shall become effective on the date of final action by the Mayor and City Council. SUMMARY: Attached is an Ordinance transferring $503,915.07 from WW9999 to WWAN03 for Project No. 20-059 (WWAN03) 2021-2023 Sanitary Sewer Point Repair - 250 William White Blvd Project. This project repaired the broken force main pipe segment and performed additional work required to protect public health and safety and the environment on the north and south sides of Highway 96. PREVIOUS COUNCIL ACTION: None BACKGROUND: On March 27, 2024, the Wastewater Department discovered a leakage in the force main near 250 William White Boulevard. After an extensive site investigation, the Wastewater Department discovered wastewater ponding in swale along the east side of the Holcim and Agra and on the north and south sides of Highway 96. In order to protect public health and safety and the environment, an emergency repair was necessary to repair the broken pipe segment, perform additional work required to mitigate wastewater ponding in swale along the east side of the Holcim and Agra and on north and south sides of Highway 96, remove and replace contaminated soil, place erosion and sediment control, remove contaminated road base and import new material and regrade swales to flow properly. FINANCIAL IMPLICATIONS: The funds in the amount of $503,915.07 are being transferred from Project WW9999 to WWAN03. The cost of the sanitary sewer emergency point repair was initially estimated at $5,500.00, but due to the additional work performed, the final cost of the repair amounted to $503,915.07. Funds are available and will be paid from the Sewer User Funds which have been budgeted and appropriated to Project No. 20-059 (WWAN03).
