HomeMy WebLinkAbout15770RESOLUTION NO. 15770 A RESOLUTION APPOINTING THE CITY CLERK AS THE DESIGNATED ELECTION OFFICIAL FOR THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 5, 2024 AND DIRECTING THE CITY CLERK TO CERTIFY THE CONTENT OF THE BALLOT FOR SAID ELECTION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Clerk shall be and hereby is appointed as the Designated Election Official for the November 5, 2024 Special Municipal Election. SECTION 2. The content of the ballot for the City's Special Municipal Election to be held on November 5, 2024 shall be as follows: Ballot Question No. 2A - Charter Amendment Municipal Court Maximum Fines Shall Sections 3-5 and 5-2 of the Charter of the City of Pueblo be amended to update the Charter to allow City Council to set by ordinance the maximum penalty to be imposed by Municipal Court consistent with Colorado Revised Statutes? Yes _____ No _________ Ballot Question No. 2B - Charter Amendment Modernize Terms & Technology Shall the Charter of the City of Pueblo be amended to update and modernize terms and technology referenced within the Charter, and in connection therewith: amend Section 1-5 to include significant financial loss to the City in the definition of emergency ordinance; clarify Section 2-6 as to when an elected office is deemed vacant; amend Sections 2-10 and 3-19 to allow for publication of legal notices on the CSection 3-9 providing City Council may enter into contracts and leases; amend Section 3-18 to change the font used when amending the Charter and Municipal Code; amend Section 3-20 to include prevention of significant financial loss under Emergency Ordinances; amend Section 3-21 to remove the requirement that a paper copy of indexed ordinances be kept; amend Section 6-1 to remove the residency requirement for the City Attorney; amend Section 7-28 to allow the unit cost required for equipment-owned record keeping to be set by Ordinance; delete Section 8-12 to remove compulsory retirement; amend Section 15-6 to allow contract and purchase amount allowed by Trustees or Commissioners of Water Districts to be set by Ordinance and allowing publication of notice online? Yes __________ No __________ Ballot Question No. 2C - Charter Amendment Greater Election Coordination Shall Article 19 of the Charter of the City of Pueblo be amended to allow for greater expense by extending the time allowed for the recall of elective officers? Yes _____ No _______ Ballot Question No. 2D - Charter Amendment Municipal Election Provisions Shall the Charter of the City of Pueblo be amended as follows to amend Section 4-2 to adjust the MSection 17-2 to allow for flexibility in the date of the runoff election; amend Section 17-5 to allow the timeframe for submission of petitions to be set by Ordinance; amend Section 17-6 to identify mail-in ballot as the preferred method; delete Sections 17- 8 and 17-9 to remove the City C Section 17- to be set by Ordinance? Yes _____ No ________ SECTION 3. The City Clerk shall be and hereby is directed to certify the content of the ballot for the November 5, 2024 Special Municipal Election in accordance with applicable law. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 5. This Resolution shall take effect immediately upon final passage and approval. This Resolution also directs the City Clerk to certify the content of the ballot for said election. PREVIOUS COUNCIL ACTION: On July 8, 2024, by Ordinance No. 10737, City Council directed that the November 5, 2024 Special Election be conducted as part of a Coordinated Election with Pueblo County. BACKGROUND: C.R.S. 1-5-203 (3)(a) requires that the Designated Election Official of each political subdivision participating in a Coordinated Election to certify the order of the ballot and ballot content. Such certification is to be delivered to the County Clerk and Recorder no later than sixty (60) days before the Coordinated Election. FINANCIAL IMPLICATIONS: The City shall pay to the County Clerk the City's share of the actual cost of materials and Election. Funding for the costs associated with conducting this Special Municipal BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: If this Resolution is not adopted, the City will be unable to proceed with the November 5, 2024 Special Municipal Election. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: 1.
