HomeMy WebLinkAbout10779ORDINANCE NO. 10779 AN ORDINANCE APPROVING AND ENACTING THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE INTERNATIONAL BROTHERHOOD OF POLICE OFFICERS LOCAL 537 COMMENCING JANUARY 1, 2025, AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, pursuant to the requirement of Section 8-14, City Charter, the corporate authorities of the City of Pueblo and the sole and exclusive bargaining agent of the police officers, i.e. the International Brotherhood of Police Officers Local 537, have negotiated a WHEREAS, the Labor Agreement has been reduced to writing and signed by said parties pursuant to the requirements of Section 8-14(l) of the Charter, City of Pueblo, Colorado; and WHEREAS, Section 8-14(l) of the Charter of the City of Pueblo, Colorado, further requires that the Labor Agreement be enacted as an Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Collective Bargaining Agreement between the City of Pueblo and the International Brotherhood of Police Officers Local 537 commencing January 1, 2025, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved and enacted as an Ordinance. SECTION 2. The Mayor is authorized to execute the Collective Bargaining Agreement in the name of the City. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to effectuate the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Ordinance re-adopted on a vote of ____________, on _____________ ____________________________ President of City Council ATTEST ________________________________ City Clerk City Clerk's Office Item # R7 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: September 9, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Heather Graham, Mayor Robert Jagger, Deputy City Attorney Marisa Pacheco, Director of Human Resources SUBJECT: AN ORDINANCE APPROVING AND ENACTING THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE INTERNATIONAL BROTHERHOOD OF POLICE OFFICERS LOCAL 537 COMMENCING JANUARY 1, 2025, AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: Attached is a proposed Ordinance which would approve and enact the collective bargaining agreement between the City of Pueblo and the International Brotherhood of Police O-14(l) of the City Charter, any collective bargaining agreement negotiated between the Union and the City shall be reduced to writing, signed by the parties, and enacted by Ordinance. PREVIOUS COUNCIL ACTION: Not Applicable. BACKGROUND: The current collective bargaining agreement between the City and Union expires on December 31, 2024. Pursuant to the requirements of the City Charter, the City and Union commenced negotiations with respect to a successor contract in July of this year. Through the negotiation process, the parties have successfully reached a tentative agreement with respect to a successor contract. Pursuant to §8-14(l) of the Charter, such an agreement is required to be enacted as an Ordinance. The successor contract contains the following specific changes with respect to the prior contract: Article 2-Term. The term of the agreement is for three (3) years subject to City ct extension on or before June first of the then current year. If not extended by City, the complete contract shall be opened and the parties will commence the negotiation process for a successor contract in compliance with the requirement of Section 8-14, City Charter. Article 4.4. Management Rights A new section will be added to this article which will allow the Mayor to declare an emergency based on sworn staffing levels falling below 30% of authorized staffing. The emergency declaration would permit the Mayor to suspend any provision of the agreement as may be reasonably appropriate to timely and effectively fulfill the function of the ability to determine employee work schedules and hours of work; notice periods for changes in work schedules and work hours; seniority requirements for distribution of overtime or on-duty work; and restrictions on assignment or reassignment. y is subject to and conditioned upon: (1) City Council approval by passage of an emergency ordinance; and (2) presentation of such ordinance to the Mayor and passage of such ordinance by City Council. Article 16-Salary. 2025 - For 2025, the monthly pay rate for Police Patrol Officer/ Police Corporal at all steps will be increased by 7% over the amount set by Ordinance establishing 2024 pay levels. The monthly pay rate for Police Sergeant at all steps will be increased by 10% over the amount set by Ordinance establishing 2024 pay levels. 2026 - For 2026, the monthly pay rate for Police Patrol Officer/Police Corporal and Police Sergeant at all steps will be increased by the average annual base pay percentage increase in the rate of top steps for like positions in the following cities: Arvada, Aurora, Colorado Springs, Denver, Fort Collins, Lakewood, Thornton and Westminster. Average annual base pay percentage increase shall be based upon the annual increase in the rate of pay for year 2026, if known, or year 2025 otherwise. This accounts for any agencies who are still determining their increases through collective bargaining or otherwise at the time the contract extension must be presented to City Council in accordance with City Charter. 2027 For 2027, the same methodology shall apply as outlined above however, such increase will be based on average annual base pay percentage increase for year 2027, if known, or year 2026 otherwise. In addition, and to the extent such an increase is not deemed acceptable by either party, a limited wage reopener clause is provided that will allow either the Union or the City to reopen the contract to negotiate only on salary under Article 16. Such limited reopening, if requested, shall be subject to the timelines and procedures under Section 8-14(r) through 8-14(v) City Charter. Article 23.1.1. Insurance. For 2025, 2026 and 2027, the City will increase contributions levels to each plan and coverage level to match contributions levels of other groups in the City (Pueblo Association of Government Employees and non-bargaining positions). All other provisions currently in place with respect to premium increase sharing and self-funding remain unchanged as previously negotiated. Article 27 Sick Leave This article will be amended to reflect changes in Colorado state law under the Healthy Families and Workplaces Act which was implemented after the previous contract was negotiated. Article 34.3 Reporting Current language will be changed to reflect unauthorized absences of more than 40 consecutively scheduled work hours (vs. the current language of more than five working days) shall constitute a resignation form employment by the employee. Article 45 Shift Differential. This article will be amended to provide a higher, more competitive shift differential amount to those union members working either afternoon shift or graveyard shift as defined in the agreement. Afternoon shift differential will increase from $0.40 cents per hour to $0.80 cents per hour and graveyard shift will increase from $0.80 cents per hour to $1.60 per hour. FINANCIAL IMPLICATIONS: Following are the approximate cost increases for 2025, if the ordinance is approved: - 2025 Wage Increase $359,010 for Police Sergeants $1,280,972 for Police Patrol Officers/Police Corporals - Health Insurance $27,513 contribution increase - Shift Differential Increase $24,485 $1,691,980 BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: The International Brotherhood of Police Officers #537 held a membership vote on August 1, 2024, and ratified the negotiated changes to the contract, subject to City Council approval as accomplished by this ordinance. ALTERNATIVES: If approved, the requirements of §8-14(l) of Charter require the agreement be enacted as an Ordinance. RECOMMENDATION: City Administration recommends approval of this Ordinance.
