HomeMy WebLinkAbout10778ORDINANCE NO. 10778 AN ORDINANCE DESIGNATING 330 SOUTH CITY PARK AVENUE, CITY PARK BATH HOUSE, AS A LOCAL HISTORIC LANDMARK WHEREAS, , the City of Puebl states that the City shall identify, designate and preserve those buildings, objects, monuments, cultural heritage; and, WHEREAS, the present application was initiated by the Historic Preservation Commission designation of 330 South City Park Avenue, the City Park Bath House, as a Local Historic Landmark and has recommended to the Planning and Zoning Commission the designation of this resource; and, WHEREAS, , the City Planning and Zoning Commission has reviewed the Historic ion and the designation application and submitted its recommendation against the landmark designation to Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City Council finds and determines that 330 South City Park Avenue, Pueblo, Colorado, the City Park Bath House, is associated with history, and architecture. It qualifies under landmark Criteria 1A, significant events/people, and qualifies under landmark Criteria 2A, architecture, and complies with the criteria as defined in the Pueblo Historic Preservation Code Section 4-14-8. SECTION 2. The City Council hereby designates 330 South City Park Avenue, the City Park Bath House, as a local Pueblo Historic Landmark, subject to the benefits, obligations and restrictions resulting from such designation as described in Chapter 14, Title IV of the Pueblo Municipal Code. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The Historic Preservation Commission applied to designate 330 South City Park Avenue, City Park Bath House, as a local Historic Landmark, without the consent of the landowner, the City of Pueblo as provided in PMC 4-14-8 (C). The applicant provided documentation to demonstrate that the residence was constructed in 1938 and associated with the Works Progress Administration, whose workman constructed the building as part of a depression era initiative to provide work to unemployed people while creating lasting public amenities. The applicant is seeking a local Historic Landmark designation to protect the building from demolition and to begin a campaign to restore it. The structure qualifies under landmark Criteria 1A, significant events/people, for having direct association with the Works Progress Administration who played a significant role in Depression era US, Colorado and Pueblo. The building also qualifies for nomination under criteria 2A, architecture, as a good example of a Parkitecture Architectural Style. The Pueblo Regional Comprehensive Plan identifies the building within a , Parks and Open Space future land use designation. , The landmarking and preservation of the building is not part of the goals of the redevelopment plans for City Park. The redevelopment plan includes the replacement of the bath house with a modern building that better supports the adjacent tennis and recreational uses. A detailed review of the Comp Plan compliance is discussed in the staff report, for case number HPC-24-07. FINANCIAL IMPLICATIONS: The designation would halt redevelopment of the site and may cost American Recovery st Act funds dedicated to this Project that need to be spent by December 31, 2025. BOARD/COMMISSION RECOMMENDATION: The Historic Preservation Commission, at their August 21, 2024 Regular Meeting, voted 6-0 to recommend approval, Commissioner Perko absent. The Planning and Zoning Commission, at their August 21, 2024, Regular Meeting, voted 3-3 to recommend denial, Commissioner Spinuzzi absent. STAKEHOLDER PROCESS: The application was reviewed at a public hearing held by the Pueblo Historic Preservation Commission held on August 21, 2024 and the application was also reviewed by the City of Pueblo Planning and Zoning Commission at their August 21, 2024 meeting. ALTERNATIVES: If City Council does not approve this Ordinance, 330 South City Park Avenue, will not be designated as a Local Historic Landmark. Upon request of City Council, the Ordinance could be returned to the Historic Preservation Commission and the Planning and Zoning Commission for consideration of proposed modifications.
