AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM A -4, AGRICULTURAL FOUR DISTRICT; R -5,
MULTIPLE - OFFICE AND RESIDENTIAL DISTRICT AND S-
1, GOVERNMENTAL USE DISTRICT TO A -2,
AGRICULTURAL TWO DISTRICT COVERING A PARCEL
OF LAND GENERALLY LOCATED EAST OF PUEBLO
BOULEVARD AND WEST OF MEADOW VALLEY DRIVE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO. that:
SECTION 1.
The zoning restrictions covering the following described property be changed
from A -4, Agricultural Four District; R -5, Multiple- Office and Residential District and S -1,
Governmental Use District to A -2, Agricultural Two District, and upon passage of this
Ordinance, zoning restrictions affecting A -2, Agricultural Two District, shall apply to said
property as follows:
Lot 1, Paws Subdivision, according to the recorded plat thereof filed for
record December 4, 2007 at Reception No. 1750671 in the records of the
Pueblo County Clerk and Recorder.
Contains 3.37± acres (146,947± s.f.)
AND
Lots 1, Special Area Use Plan of Meadow Valley Estates according to the
recorded plat thereof, filed November 27, 1981 at Reception No. 679432,
in Book 2094 at Pages 795 -796, in the records of the Pueblo County Clerk
and Recorder.
Contains 0.82± acres (35,868± s.f.)
and more commonly known as:
Property generally located east of Pueblo Boulevard and west of Meadow Valley
Drive.
SECTION 2.
This Ordinance is approved with the condition that landscaping be incorporated
into the project area to buffer the new shelter, clinic, day -care and park from the existing
residential uses.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve a request to rezone the property from A -4, Agricultural Four District;
R -5, Multiple- Office and Residential District and S -1, Governmental Use District to A -2,
Agricultural Two District?

The Planning and Zoning Commission, at their March 11, 2009 Regular Meeting, voted 4 -0 -1 to
recommend approval with the following condition:
Landscaping be incorporated into the project area to buffer the new shelter, clinic, day -care and
park from the existing residential uses.
BACKGROUND
The applicant is requesting to rezone the subject site to A -2 in order to facilitate expansion of
the existing Animal Welfare and Protection Society, a non - profit organization. The subject site
consists of Lot 1, PAWS Subdivision; Lots 1 -3 and a portion of Parcel A of the Special Area
Plan of Meadow Valley Estates. Currently this area is zoned A -4, R -5 and S -1. The S -1 zoned
area, which is typically reserved for governmental uses, contains the existing animal shelter.
On March 14, 2007, the Planning and Zoning Commission issued a Special Use Permit, on Lot
1, PAWS Subdivision, allowing the Animal Welfare and Protection Society to operate a "no kill"
animal shelter within the S -1 Zone District. The Organization has since acquired additional
property to the east and is currently subdividing the entire property for their use. The existing
Special Use Permit does not extend to the additional property. The rezone of the entire area of
the proposed subdivision will allow the proposed facility expansions as 'use by right'. Proposed
facilities will consist of expansion of the animal shelter, doggie daycare, veterinarian emergency
clinic /hospital and "bark park ". Landscaping is not required in the A -2 Zone District; however,
Staff recommends that a landscape buffer and other features be incorporated into the site in an
effort to make the commercial development more compatible with the surrounding residential
and agricultural uses.
