PACHECO, DIRECTOR TITLE AN ORDINANCE VACATING PORTIONS OF THE ALLEYS ADJACENT TO C AND D STREETS AND VACATING PORTIONS OF MECHANIC, ONEIDA AND C STREETS WITHIN BLOCKS 69,78 AND 79, TOWN OF SOUTH PUEBLO SUBDIVISION ISSUE Shall City Council approve the request to vacate portions of the alley, adjacent to D Street and C Street within Block 69; vacate the eastern 32.60 -feet of Mechanic Street; vacate all of the alley within Block 79; vacate a triangular remnant piece of Oneida Street, located adjacent to the railroad property; and vacate a portion of C Street that sits between the railroad property and Mechanic Street? The Planning and Zoning Commission, at their March 11, 2009 Regular Meeting, voted 5 -0 to recommend approval. Due to an issue concerning notification of the property owners within 300 feet of this vacation, Notices were resent and a public hearing was again held at the May 13, 2009 Regular Meeting of the Planning and Zoning Commission. All other items being the same, the Planning and Zoning Commission voted 5 -0 to recommend approval. BACKGROUND The City is proposing six vacations within three blocks of the South Pueblo Subdivision in order to facilitate the proposed Pueblo Municipal Complex, Filing No. 1 Subdivision and the construction of the Pueblo Justice Center and Police Annex. January 8, 1951 the middle section of the alley, that traverses Block 69, was vacated. The City proposes to vacate the remnant portions of the alley, which includes a 1,000- square foot section adjacent to D Street and a 1,500- square foot section adjacent to C Street. In an effort to make room for the new Justice Center, the modular Wastewater Department was moved south placing a portion of the structure within the Mechanic Street right -of -way. Therefore, a 32.60 -foot strip of Mechanic Street will be vacated to accommodate the Wastewater Department and correct the current encroachment. All of the alley located in Block 79, South Pueblo will be vacated as well as a triangular shaped piece of Oneida Street, situated between Lots 17 -19, Block 79 and the railroad property. Finally, an 8,750 square foot portion of C Street, located between railroad property and Mechanic Street will be vacated. This portion of C Street is currently being used as parking for the Purchasing Department and is no longer used for right of way. All vacations are a necessary component of the Justice Center redevelopment project and none of which appear to pose a problem with access. FINANCIAL IMPACT None.
