AN ORDINANCE CHANGING ZONING RESTRICTIONS
FOR PORTIONS OF THE FORMER TOWN OF SOUTH
PUEBLO, BLOCKS 68, 69 AND 79 INCLUDING ALL
VACATED RIGHTS -OF -WAY FROM 1 -2, LIGHT
INDUSTRIAL DISTRICT, 1 -3, HEAVY INDUSTRIAL
DISTRICT AND S -1, GOVERNMENTAL USE DISTRICT TO
S -1, GOVERNMENTAL USE DISTRICT COVERING A
PARCEL OF LAND GENERALLY LOCATED BETWEEN
MAIN STREET AND THE RAILROAD PROPERTY AND C
AND D STREETS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions for portions of the Former Town of South Pueblo, Blocks
68, 69 and 79 including all vacated rights -of -way from 1 -2, Light Industrial District, 1 -3,
Heavy Industrial District and S -1, Governmental Use District to S -1, Governmental Use
District, and upon passage of this Ordinance, zoning restrictions affecting S -1,
Governmental Use District, shall apply to said properties as follows:
Commencing at a point, said point being a City of Pueblo monument in the intersection
of South Main Street and 'D' Street monumented by lead plug and tack in monument
box. Thence N 90 00'00 "W a distance of 14.15 feet to the Point of Beginning. Thence
along the following 13 courses:

SECTION 2.
This Ordinance is approved with the condition that all lighting must be reviewed
at the time of installation, by staff, to determine if field adjustment is necessary to
mitigate glare.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve a request to rezone the properties from 1 -2, Light Industrial
District, 1 -3, Heavy Industrial District and S -1, Governmental Use District to S -1,
Governmental Use District to facilitate the construction of the Pueblo Judicial Center
and Police Annex?
The Planning and Zoning Commission, at their March 11, 2009, Regular Meeting voted
5 -0 to recommend approval with the following condition:
All lighting must be reviewed at the time of installation, by staff, to determine if field
adjustment is necessary to mitigate glare.
Due to an issue concerning notification of the property owners within 300 feet of this
rezoning, Notices were resent and a public hearing was again held at the May 13, 2009
Regular Meeting of the Planning and Zoning Commission. All other items being the
same, the Planning and Zoning Commission voted 5 -0 to recommend approval.
BACKGROUND
The City is requesting to rezone the subject site in order to facilitate the construction of
the Pueblo Judicial Center and Police Annex. The project site was originally platted in
1872 by William Palmer as the Town of South Pueblo. The area was consolidated into
the City of Pueblo in 1886 and developed as a mixed use retail corridor until 1921 when
it was devastated by the Great Flood. After the flood, the commercial corridor moved
north to 1 st and Main Streets, and the area transitioned toward industrial uses, including
warehousing, light manufacturing and auto service. Although some of the buildings
within Blocks 68, 69 and 79 were historic; the character of many had been
compromised by later additions and fagade modifications. All buildings located on Lots
1 -16, Block 69 were demolished in 2008 to make way for the Pueblo Justice Center.
The structures located on Lots 17 -32, Block 68 were also demolished for the
construction of the Police Annex. The proposed rezoning will aid in the transition of
downtown from an industrial area back to a commercial and service locale. Because
the Judicial Center will house the Police Department and Municipal Court the S -1
District is the most appropriate zoning. The new zone district will also allow future
municipal buildings to be constructed within the project site.
