AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM 1 -3, HEAVY INDUSTRIAL DISTRICT TO B -4,
REGIONAL BUSINESS DISTRICT COVERING PARCELS
OF LAND COMMONLY KNOWN AS 503 AND 507 EAST
11 STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:

The zoning restrictions covering the following described property be changed
from 1 -3, Heavy Industrial District to B -4, Regional Business District, and upon passage
of this Ordinance, zoning restrictions affecting B -4, Regional Business District, shall
apply to said property as follows:
West 28 ft. of Lot 7 and all of Lots 8 through 12, Block 99, Conley's
Addition to East Pueblo and one -half of all Right -of -Ways adjacent to said
lots.
and more commonly known as:
503 and 507 East 11 Street
SECTION 2.
This Ordinance is approved with the condition that landscaping for both parcels
be brought into compliance with Section 17 -4 -7 of the Municipal Code upon issuance of
a building permit for either parcel.
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve a request to rezone the property from 1 -3, Heavy Industrial District to
B -4, Regional Business District?
RECOMMENDATION
The Planning and Zoning Commission, at their May 13, 2009 Regular Meeting, voted 4 -0 to
recommend approval with the following condition:
Landscaping for both parcels must be brought into compliance with Section 17 -4 -7 of the
Municipal Code upon issuance of a building permit for either parcel.
BACKGROUND
Ms. Harper owns two single - family residences located east of Fountain Creek in an 1 -3 Zone
District. According to the 1905 Sanborn Insurance Maps, the house addressed as 507 E. 11
Street was constructed prior to 1905. It appears that the house located at 503 E. 11 was
constructed later, between 1906 and 1929. Both residences were established prior to the first
city wide Zoning Ordinance in 1931 and the more notable 1968 city wide rezoning in which
modern zoning practices were instituted within the City.
The residential uses are now considered legal non - conforming uses, which allow the use to
remain until the use has ceased for six consecutive months or for 18 months in a three -year
period. The property owner wishes to rezone the property to B -4, Regional Business District,
which will allow the residential uses to remain as uses by right because they were established
prior to 1968. The rezoning will grant the property owner the opportunity to draw equity out of
the homes through a reverse mortgage so that she can finance maintenance costs for both
properties. The B -4 rezoning will also allow future commercial redevelopment of the property.
Staff recommends that all landscaping improvements for the two properties be deferred until
development of either property occurs. The rationale for this request is that no changes are
being made to the property at this time. Once a building permit is issued or a change of use has
occurred, landscaping conforming to municipal standards will have to be instituted within that
parcel.
