ML0603 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Minnequa Lake Capital Improvement Project is hereby budgeted and appropriated an increase of $474,419.00 to the 2009 Capital Budget. SECTION 2. $249,419.00 is hereby transferred from the Minnequa Lake Feeder Ditch Project No. SW0601 to the Minnequa Lake Construction Project No. ML0603. ML0603 ISSUE Should the City Council approve an Ordinance transferring $249,419.00 from the Lake Minnequa Feeder Ditch Project No. SW0601, $25,000.00 from the Lake Minnequa Multi -use Facility Project No. SW0602, transferring $200,000.00 in funds from the Lower Arkansas Valley Water Conservancy District and budget and appropriate an increase of $474,419.00 to the Minnequa Lake Construction Project No. ML0603? Approval of the Ordinance. BACKGROUND On August 14, 2006, the City approved Ordinance No. 7502 budgeting and appropriating $4,650,000.00 for the land acquisition and construction of the Minnequa Lake Park and Open Space Project. The revised budget reviewed with City Council in October 2008 for the project is $5,124,419.00, which is an increase of $474,419.00. The main reasons for the additional expense is the completion of a voluntary clean up plan for the 1.75 -acre slag area located along the southeast side of the lake and additional costs for the purchase of the Evraz /Rocky Mountain Steel outlet pipe system to drain stormwater and pass through water provided by the Lower Arkansas Valley Water Conservancy District out of lake. The stormwater funds in the Lake Minnequa Feeder Ditch Project No. SW0601 and the Lake Minnequa Multi -use Facility Project No. SW0602 are approved in the 2009 budget and will be transferred into the Minnequa Lake Construction Project No. ML0603. The funding sources for the project are listed below based on whether the revenues are fully secured, pending final commitment to the project, and city general funds. Water Conservancy District (to be paid in 2010 and 2011) $ 400,000 Colorado Division of Wildlife (In -Kind) $ 10,000 Arkansas Valley Audubon Society (In -Kind) $ 10,000 Sub -Total Pending Funding $ 820,000 Total Cost $5,124,419 FINANCIAL IMPACT A total of $820,000.00 of the General Fund revenues will to be reimbursed from contributions from a Colorado Division of Wildlife Fishing Is Fun grant ($100,000.00), remaining funds committed by the Lower Arkansas Valley Water Conservancy District ($400,000.00), $300,000.00 in from City Conservation Trust Funds in 2010, and volunteer commitments from the Colorado Division of Wildlife and the Arkansas Valley Audubon ($20,000.00). A total of $336,400.00 of the General Funds will ultimately be used for the first phase of the project. The City will be required to pay for the construction of the project initially from City funds and following completion of each portion of the project in which grant funds have been contracted; the City will be reimbursed by the funding agency. City must maintain the improvements at Lake Minnequa during its useful life. The stormwater improvements will be funded from the Stormwater Utility and the other park and open space improvements (trails, picnic shelter, parking, basketball courts, and upland open space) would be paid from the General Fund.
