ORDINANCE NO. 8021
AN ORDINANCE VACATING THE INGRESS /EGRESS
EASEMENT WITHIN LOT 1 AND LOT 3, BLOCK 1, LAKE
GARDENS 4 FILING
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described Ingress /Egress Easement: '
An Ingress /Egress Easement, being'the North 25' of Lots 1 &,3, Block 1,
Lake Gardens Subdivision, 4` Filing excepting therefrom the west 30 feet of
Lot 3
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

AN ORDINANCE VACATING THE INGRESS /EGRESS EASEMENT WITHIN LOT 1
AND LOT 3, BLOCK 1, LAKE GARDENS 4 FILING
ISSUE
Shall City Council approve the proposed 25 -foot Ingress /Egress Easement vacation
located in the northern portion of Lot 1 and Lot 3, Block 1, Lake Gardens 4 1 Filing?
RECOMMENDATION
The Planning and Zoning Commission, at their March 11, 2009 Regular Meeting, voted
5 -0 to recommend approval.
BACKGROUND
The applicant proposes to vacate the 25 -foot Ingress /Egress Easement located in the
northern portion of Lots 1 and 3, running adjacent to Pueblo Boulevard. The easement
was platted to provide access to Lot 3 from Lot 1, but was never used because both
lots had direct access off of Pueblo Boulevard. Furthermore, the proposed
rearrangement of property boundaries will combine Lots 1, 2 and 3 into one large lot
thereby canceling out current or future need for the ° Ihgress /Egress Easement.
According to the application, the vacation is necessary for the property owners to
expand the existing liquor store, add parking and landscaping to improve the function
and aesthetics of the property.
