TITLE
AN ORDINANCE VACATING THE PUBLIC UTILITY EASEMENT WITHIN LOT 1,
BLOCK 10, EAGLERIDGE ESTATES, FILING NO. 2
ISSUE
Shall City Council approve the proposed vacation of the 20 -foot Public Utility Easement
that spans the entire length of Lot 1, Block 10, Eagleridge Estates, Filing No. 2 along
the northern line of the drainage easement on the south side of the property?
RECOMM ENDATION
The Planning and Zoning Commission, at their April 16, 2009, Regular Meeting, voted
5 -0 to recommend approval.
BACKGROUND
The subject Public Utility Easement was originally platted with the Eagleridge Estates,
Filing No. 2 Subdivision to provide utilities for future development within Lot 1. A
Condominium Map was recorded for the site in August of 2008, which dedicated an
alternate easement for utilities and ingress /egress. The new easement was created to
better accommodate future development, making the original easement redundant.
The proposed easement vacation will facilitate additional commercial development by
releasing .55 -acres that would otherwise be non - developable.
FINANCIAL IMPACT
None.
