The following described Public Utility Easement: 20 -foot Public Utility Easement located in Lot 1, Block 10, Eagleridge Estates, Filing No. 2 is hereby vacated. SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE VACATING THE PUBLIC UTILITY EASEMENT WITHIN LOT 1, BLOCK 10, EAGLERIDGE ESTATES, FILING NO. 2 ISSUE Shall City Council approve the proposed vacation of the 20 -foot Public Utility Easement that spans the entire length of Lot 1, Block 10, Eagleridge Estates, Filing No. 2 along the northern line of the drainage easement on the south side of the property? RECOMM ENDATION The Planning and Zoning Commission, at their April 16, 2009, Regular Meeting, voted 5 -0 to recommend approval. BACKGROUND The subject Public Utility Easement was originally platted with the Eagleridge Estates, Filing No. 2 Subdivision to provide utilities for future development within Lot 1. A Condominium Map was recorded for the site in August of 2008, which dedicated an alternate easement for utilities and ingress /egress. The new easement was created to better accommodate future development, making the original easement redundant. The proposed easement vacation will facilitate additional commercial development by releasing .55 -acres that would otherwise be non - developable. FINANCIAL IMPACT None.
