AN ORDINANCE AMENDING THE CITY OF PUEBLO'S 2008 -2009
CONSOLIDATED ANNUAL ACTION PLAN APPROVED AND ADOPTED
BY ORDINANCE 7695, ESTABLISHING THE NEEDS AND PRIORITIES
OF THE CITY AS REQUIRED BY THE U.S. DEPARTMENT OF HUD AND
PROVIDING STRATEGIES TO MEET THOSE NEEDS, AUTHORIZING
THE DEPARTMENT OF HOUSING AND CITIZEN SERVICES TO
SUBMIT THE PLAN TOGETHER WITH ALL REQUIRED AND
NECESSARY CERTIFICATIONS, ASSURANCES AND
DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT
WHEREAS, the City of Pueblo is a designated entitlement city under the Housing and
Community Development act of 1974; and
WHEREAS, entitlement cities are required to complete a Consolidated Annual Action
Plan for consideration of funding approval; and
WHEREAS, from time to time an entitlement city may find it necessary to amend its
approved Consolidated Annual Action Plan to meet the emerging needs of its community; and
WHEREAS, a draft copy of the substantial amendment to the 2008 -2009 Consolidated
Annual Action Plan was made available to the general public for a 12 -day public comment
period, all comments having been incorporated into the amended Plan.
NOW THEREOFRE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The substantial amendment to the City of Pueblo's 2008 -2009 Consolidated Plan Annual
Action Plan, having been on file in the City Clerk's Office for public comment, is hereby
approved, adopted and incorporated herein.
SECTION 2.
This Ordinance shall become effective upon final approval and passage.

ISSUE
Shall City Council amend the City's 2008 -2009 Consolidated Annual Action Plan and
authorize the Department of Housing and Citizen Services to submit said amended Plan
to the U.S. Department of Housing and Urban Development.

BACKGROUND
In January 2009, the U.S. Congress passed and the President signed the American
Recovery and Reinvestment Act of 2009 (ARRA). The City of Pueblo has been
awarded $678,970 in funding under the Homeless Prevention Fund (HPRP) created
under Title XII Division A of the Act for homeless prevention and rapid re- housing of at
risk individuals and families. The grant award requires that the City do a substantial
amendment to the 2008 -2009 Action Plan to include the activities to be undertaken. It is
a HUD requirement that the City amend its plan and provide for public comments.
The needs of the homeless and the at -risk of homelessness populations for housing
and other supportive services are a stated need in the Consolidated Plan under Priority
3 and in the 2008 Annual Action Plan. This priority outlines the strategies and
accomplishments to be undertaken to meet the needs of the homeless and special
needs population as defined by HUD. At the time the Plan was developed there was no
funding available to provide for rapid re- housing and the additional supportive services
that have been made available under the Homeless Prevention Fund. The HPRP
allows grantees to provide rental assistance as well as other supportive services to
individuals who are homeless or at risk of being homeless due to recent job losses. The
City will be following the eligibility criterion as established by HUD. The amendment to
the Plan are outlined in the attached Substantial Amendment to the Consolidated Plan
2008 Action Plan for the Homelessness Prevention and Rapid Re- Housing Program
(HPRP).
The City anticipates partnering with Posada, Inc., to deliver these services. Posada is
the lead agency for the Pueblo Continuum of Care and is a subrecipient of McKinney -
Vento Homeless Assistance Act grant funds through the State's Continuum of Care
process. Posada currently offers similar services in the community and these funds will
simply allow for the addition of services. Part of the requirement of the grant is that the
grantee or its subgrantee report under the Homeless Management Information System
(HMIS) and Posada as a subgrantee of homeless prevention funding is currently
reporting on the system for its other grants. As administrative dollars are limited to 5%
of the total grant over the 3 -year period it was considered prudent to contract with an
agency that did not require start -up costs. We will develop a subrecipient agreement
with Posada and will bring that to Council for approval at a future date.
Sixty - percent of the funds must be expended within 2 years of the grant and 100%
within 3 years. All unspent funds will be recaptured.
FINANCIAL IMPACT
The amendment of the Plan has no financial impact to the General Revenue Fund. The
grant will provide $678,970 in federal funding to meet the housing needs of the
increasing unemployed population without the requirement of matching dollars. HUD
anticipates grant agreements to be executed in September 2009, with the funding being
made available shortly thereafter.
