HomeMy WebLinkAbout08003Reception 1875909 05/20/2011 ORDINANCE NO 8003 AN ORDINANCE VACATING THREE PUBLIC UTILITY EASEMENTS IN THE SUNNY HEIGHTS SUBDIVISION, 3 FILING, COMMONLY KNOWN AS NORTHEAST OF ST CLAIR AVENUE AND ARDATH LANE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The three public utility easements located in the Sunny Heights Subdivision, V Filing, more particularly described as follows All of the 10 -foot public utility easement lying between Lots 3 and 4, Block 3, Sunny Heights Subdivision, Third Filing, according to the recorded plat thereof, filed for record June 25, 1952 in Book 18 at Page 112 in the Office of the Pueblo County Clerk and Recorder, except for the northeasterly 5 feet thereof AND All of the 10 -foot public utility easement lying between Lots 6 and 7, Block 3, Sunny Heights Subdivision, Third Filing, according to the recorded plat thereof, filed for record June 25, 1952 in Book 18 at Page 112 in the Office of the Pueblo County Clerk and Recorder, except for the northeasterly 5 feet thereof AND All of the 10 -foot public utility easement Tying between Lots 10 and 11, Block 3, Sunny Heights Subdivision, Third Filing, according to the recorded plat thereof, filed for record June 25, 1952 in Book 18 at Page 112 in the Office of the Pueblo County Clerk and Recorder, except for the northeasterly 5 feet thereof are hereby vacated SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. CLAIR AVENUE AND ARDATH LANE ISSUE Shall City Council approve the vacation of three (3) public utility easements in the Sunny Heights Subdivision, 3rd Filing, commonly known as northeast of St. Clair Avenue & Ardath Lane? RECOMMENDATION The Planning and Zoning Commission, at their May 14, 2003 Regular Meeting, voted 6- 0 to recommend approval. BACKGROUND The applicant is requesting to vacate three (3) public utility easements, each approximately 10' wide and 135' long in the Sunny Heights Subdivision in order to re- subdivide the area. FINANCIAL IMPACT None.
