HomeMy WebLinkAbout08001ORDINANCE NO. 8001 AN ORDINANCE AMENDING CHAPTERS 2 AND 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO STUDENT HOUSING BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicating matter being added) SFrTinN 1 Section 1, of Chapter 2, Title XVII of the Pueblo Municipal Code is hereby amended by the addition of a new paragraph (61.2) to read as follows: (61.2) Student Housing means a residence for occupancy by groups of people not college, university, trade scnooi, or nonpront organization Tor the purpose Or providing rooms for sleeping and living purposes. Common gathering spaces, kitchen, cafeteria and sanitary facilities may also be provided. Typical uses SECTION 2. Chapter 4, Title XVII of the Pueblo Municipal Code is hereby amended by the addition of a new Section (12) to read as follows: 17 -4-12. Student Housing Performance Standards. (a) All student housing protects shall be restricted to the zone district in which they are permitted as a use by review. (b) Prior to the issuance of a building permit, all student housing protects must obtain a special use permit from the Zoning Board of Appeals as well as site plan approval by the Planning and Zoning Commission. (c) The Zoning Board of Appeals shall review and approve all requests for Student Housing subject to the procedures and requirements of Section 17 -5 -33. (d) The Planning and Zoning Commission, after notice and public hearing has been held in the manner required for a zoning map amendment, is authorized to approve, deny or approve with conditions, the development require sucn cnanges, restrictions or conditions upon the bite Plan or major revisions as deemed necessary to protect the public health, safety and welfare based on the impacts to the community including but not limited to: 1. Potential effects of the protect on the surrounding neighborhoods; 2. Building architecture; 3. Density; 4. Lot coverage; 5. Minimum and maximum parking requirements, including bicycle and 6. Landscaped open space and recreation availabilit 7. Trash and refuse facilities; 8. Sanitary sewer, including but not limited to, grinder pumps, grease traps, and similar devices; 9. Drainage and detention; 10. Access for occupants, visitors and emergency service vehicles; 11. Lighting as required by Section 17 -4-52; 12. Landscaping as required by Section 17 -4-7; 13. Laundry facilities; and 14. Roadway, sidewalk and off - street trail access to the college, university or non - profit organization. (e) The Technical Advisory Committee, as defined by Section 17 -8 -2, may by minor revisions to an approved btuaent housing bite Plan. 1. A denial by the Technical Advisory Committee may be appealed to the Planning and Zoning Commission. a) An appeal must be filed within fifteen days with the Administrative Official. b) The Planning and Zoning Commission will hear and decide the appeal within sixty days from the date of filing after proper notice and payment of the required fee by the applicant. 2. SECTION 3. Section 51 (7)(c) of Chapter 4, Title XVII of the Pueblo Municipal Code is hereby amended by the addition of a new paragraph (11) to read as follows: (11) Student Housing SECTION 4. This Ordinance shall become effective immediately after final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTERS 2 AND 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO STUDENT HOUSING ISSUE Should the City Council amend Chapters 2 and 4 of title XVII of the Pueblo Municipal Code relating to student housing? The Planning and Zoning Commission, at their March 25, 2009 Work Session, voted 5 -1 to recommend approval. BACKGROUND Presently, the Pueblo Municipal Code (PMC) only permits housing based on a maximum of three (3) unrelated individuals residing in any dwelling unit, whether single - family or multi - family. A developer of a student housing project requested that the Planning Department preliminarily review plans for a student housing complex where they would be designed for four (4) unrelated students in each dwelling unit. Under the current regulations, this development would not be permitted. FINANCIAL IMPACT None.
