AN ORDINANCE VACATING THE ALLEY ADJACENT TO
LOT 8 WITHIN BLOCK 1, FEARNOWVILLE SUBDIVISION
GENERALLY LOCATED AT 3032 EAST 4 STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described alley adjacent to Lot 8 within Block 1, Fearnowville
Subdivision:
ALL OF THE 15 FOOT WIDE ALLEY WITHIN BLOCK 1, FEARNOWVILLE,
ACCORDING TO THE RECORDED PLAT THEREOF, FILED FOR
RECORD AUGUST 31, 1948 AT RECEPTION NO. 821373 IN THE
RECORDS OF THE PUEBLO COUNTY CLERK AND RECORDER.
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the proposed 15 -foot alley vacation adjacent to Lot 8, Block
1 Fearnowville Subdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their February 11, 2009, Regular Meeting,
voted 6 -0 to recommend approval.
BACKGROUND
The applicant proposes to vacate the entire alley adjacent to the east side of their lot in
order to increase the width of the lot. Lot 8 contains a single - family home and is used
for residential purposes in the 1 -2, Light Industrial Zone District. The use is allowed as a
legal non - conforming use and the lot is considered a legal non - conforming lot because
of its substandard width. Presently, Lot 8 is approximately 42' wide; the standard width
for the 1 -2 District is 50' wide. The alley vacation will add an additional 15' of frontage,
which will bring the lot into compliance with Sec. 17 -4 -2 (c) of the Pueblo Municipal
Code.
