HomeMy WebLinkAbout07992ORDINANCE NO. 7992 AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR PORTIONS OF LOT 3, BLOCK 1 OF PARK WEST BUSINESS CAMPUS FILING NO. 5 FROM B -3 HIGHWAY AND ARTERIAL BUSINESS DISTRICT TO R -5 MULTIPLE RESIDENTIAL AND OFFICE DISTRICT, AND S -3, FLOOD PLAIN DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED NORTH OF 31 STREET AND EAST OF PUEBLO BOULEVARD BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering portions of Lot 3, Block 1 of Park West Business Campus Filing No. 5 be changed from B -3, Highway and Arterial Business District to R- 5, Multiple Residential and Office District and S -3, Flood Plain District, and upon passage of this Ordinance, zoning restrictions affecting R -5, Multiple Residential and Office District and S -3, Flood Plain District, shall apply to said properties as follows: Lot 1: A parcel of land located in Lot 3, Block 1 of Park West Business Campus, Filing No. 5 recorded at Reception No. 1768305, in the Southwest Quarter of the Southwest Quarter of Section 15 and the Northwest Quarter of the Northwest Quarter of Section 22, Township 20 South, Range 65 West of the 6 Principal Meridian, County of Pueblo, State of Colorado, more particularly described as follows: The Basis of Bearings is N 88 0 42'57" E from the Southwest Corner of said Section 15, as monumented by a Bureau of Land Management brass cap stamped "1964 ", a distance of 1299.94 feet along the South line of said Section 15 to the Southeast Corner of the Southwest Quarter of the Southwest Quarter of said Section 15, as monumented by an aluminum cap stamped "LS 12933 ". PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FOR PORTIONS OF LOT 3, BLOCK 1 OF PARK WEST BUSINESS CAMPUS FILING NO. 5 FROM B -3 HIGHWAY AND ARTERIAL BUSINESS DISTRICT TO R -5 MULTIPLE RESIDENTIAL AND OFFICE DISTRICT, AND S -3, FLOOD PLAIN DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED NORTH OF 31 STREET AND EAST OF PUEBLO BOULEVARD ISSUE Shall City Council approve a request to rezone the properties from B -3, Highway and Arterial Business District to R -5, Multiple Residential and Office District and S -3, Flood Plain District? The Planning and Zoning Commission, at their February 11, 2009, Regular Meeting voted 7 -0 to recommend approval. BACKGROUND Portions of Lot 3, Block 1 of Park West Business Campus Filing No. 5 are being zoned from a B -3, Highway and Arterial Business District to R -5, Multiple Residential and Office District that will allow for the development of an assisted living facility and a S -3 Flood Plain District covering the existing drainage arroyo that will be reserved to retain and provide for the unobstructed passage of flood waters and give protection from flooding. The balance of the parcel will remain within the B -3, Highway and Arterial Business District. The zoning requests conform to the Pueblo Comprehensive Plan and minimum district requirements. FINANCIAL IMPACT None.
