AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM A -1, PUEBLO COUNTY AGRICULTURAL ONE TO I-
3, HEAVY INDUSTRIAL ZONE DISTRICT AND A -1,
AGRICULTURAL ONE ZONE DISTRICT COVERING A
PARCEL OF LAND LOCATED EAST OF THE SAINT
CHARLES RESERVOIRS 1 AND 2 AND 1 -25 AND SOUTH
OF MINNEQUA INDUSTRIAL PARK, FILING NO. 3
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from A -1,
Pueblo County Agricultural One to 1 -3, Heavy Industrial Zone District and A -1,
Agricultural One Zone District, and upon passage of this Ordinance, zoning restrictions
affecting 1 -3, Heavy Industrial Zone District and A -1, Agricultural One Zone District, shall
apply to said property as follows:
A parcel of land located in a portion of the S Y2 of Section 36, Township 21 South,
Range 65 West and a portion of Section 1, Township 22 South, Range 65 West of the
6 P.M. in the County of Pueblo and State of Colorado and being more particularly
described as follows:
Considering the South line of the SE Y4 of Section 1, Township 22 South, Range 65
West of the 6 P.M. to bear N. 89 °09'31" W. and all bearings contained herein being
relative thereto.
A -1 to 1 -3
Commencing at the E Y4 corner of Section 35, Township 21 South, Range 65 West of
the 6 P.M.; thence S. 89 °46'47" E. a distance of 824.39 feet to the Point of Beginning;
thence; S. 89 °46'47" E., a distance of 2154.23 feet to a point on the Westerly right -of-
way line of the Burlington Northern & Santa Fe Railroad as presently located; thence S.
02 °28'44" W., along the Westerly right -of -way line of the said Burlington Northern &
Santa Fe Railroad, a distance of 6118.17 feet to a point on the Northerly right -of -way
line of Lime Road; thence along the Northerly right -of -way line of said Lime Road the
following three (3) courses:

and State of Colorado and being more particularly described as follows:
Considering the South line of the SE Y4 of Section 1, Township 22 South, Range 65
West of the 6 P.M. to bear N. 89 0 09'31" W. and all bearings contained herein being
relative thereto.

Beginning at the E Y4 corner of Section 35, Township 21 South, Range 65 West of the
6 P.M.; thence; S. 89 0 46'47" E., a distance of 824.39 feet; thence S. 02 0 28'44" W., a
distance of 6298.30 feet to a point on the Northerly right -of -way line of Lime Road as
presently located; thence S. 04 0 32'24" E., a distance of 110.00 feet to a point on the
Southerly right -of -way line of Lime Road; thence S. 85 0 27'36" W., along the Southerly
right -of -way line of said Lime Road, a distance of 3575.61 feet; thence N. 00 °15'11" E.,
a distance of 3980.86 feet; thence N. 89 0 44'49" W., a distance of 179.38 feet to a point
on the Easterly right -of -way line of Colorado Interstate No. 25 as presently located;
thence Northerly along the Easterly right -of -way of said Colorado Interstate No. 25 the
following three (3) courses:

2. Northerly along the arc of a curve to the left

ISSUE
Shall City Council approve a request to rezone the property from A -1, Pueblo County
Agricultural One to 1 -3, Heavy Industrial Zone District and A -1, Agricultural One Zone
District?
The Planning and Zoning Commission, at their February 11, 2009 Regular Meeting,
voted 6 -0 -1 to recommend approval.
BACKGROUND
The applicant is requesting to zone the subject site in order to facilitate development of
a manufacturing plant and to fulfill statutory regulations requiring newly annexed land to
be zoned within 90 days of the annexation. The property in question was annexed into
the City in October 2008 for the proposed Vestas Towers America, wind turbine tower
manufacturing plant. According to the Annexation Agreement Master Development
Plan, "Phase 1", approximately 306.55- acres, will house the wind turbine tower
manufacturing facility and will be zoned for industrial uses. "Phase 2 ", approximately
510.62- acres, will be zoned A -1, until new development is proposed or expansion of the
turbine tower plat is necessary. An Overall Development Plan is not required prior to
subdivision because the entire annexation tract is being subdivided at one time.
The A -1 site consists of 510.62 -acres and is located adjacent to 1 -25. The 1 -3 site is
306.55 -acres and is located east of the proposed A -1 site. According to the Annexation
Agreement the proposed 1 -3, Heavy Industrial Zoning is the most appropriate land use
classification for the proposed manufacturing use. The applicants have requested to
zone the remainder of the annexation site to A -1, which will allow them to continue the
agricultural use of land until new development is proposed or expansion of the turbine
tower plat is necessary.
