AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, SINGLE FAMILY
RESIDENTIAL DISTRICT TO R -4, MIXED RESIDENTIAL DISTRICT COVERING A
PARCEL OF LAND COMMONLY KNOWN AS 2928 WITHERS AVENUE
ISSUE
Shall City Council approve a request to rezone the property from R -2, Single Family
Residential District to R -4, Mixed Residential District?
The Planning and Zoning Commission, at their February 11, 2009, voted 7 -0 to
recommend approval with the following condition:
All landscaping and site improvements are to be completed within 18 months of City
Council approval.
BACKGROUND
The applicant is requesting a zone change in order to promote reuse of the vacated
Lighthouse Bible Church. The church was constructed around 1960 prior to current
zoning regulations, which require a Special Use Permit for Churches to operate in R -2
Zone Districts. The church has functioned as a legal non - conforming use for over 40
years, embedded within the west -side neighborhood. The proposed R -4 Zone District
will allow an adult day care use as a Use by Review.
FINANCIAL IMPACT
None.
