HomeMy WebLinkAbout07983ORDINANCE NO. 7983 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, SINGLE FAMILY RESIDENTIAL DISTRICT TO R -4, MIXED RESIDENTIAL DISTRICT COVERING A PARCEL OF LAND COMMONLY KNOWN AS 2928 WITHERS AVENUE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SFrTinN 1 The zoning restrictions covering the following described property be changed from R -2, Single Family Residential District to R -4, Mixed Residential District, and upon passage of this Ordinance, zoning restrictions affecting R -4, Mixed Residential District, shall apply to said property as follows: Lots 33 -40, Block 161, Fairmount Park 1st Filing, City of Pueblo, Colorado and more commonly known as: 2928 Withers Avenue SECTION 2. This Ordinance is approved with the condition that all landscaping and site improvements are to be completed within 18 months of the effective date of this Ordinance. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, SINGLE FAMILY RESIDENTIAL DISTRICT TO R -4, MIXED RESIDENTIAL DISTRICT COVERING A PARCEL OF LAND COMMONLY KNOWN AS 2928 WITHERS AVENUE ISSUE Shall City Council approve a request to rezone the property from R -2, Single Family Residential District to R -4, Mixed Residential District? The Planning and Zoning Commission, at their February 11, 2009, voted 7 -0 to recommend approval with the following condition: All landscaping and site improvements are to be completed within 18 months of City Council approval. BACKGROUND The applicant is requesting a zone change in order to promote reuse of the vacated Lighthouse Bible Church. The church was constructed around 1960 prior to current zoning regulations, which require a Special Use Permit for Churches to operate in R -2 Zone Districts. The church has functioned as a legal non - conforming use for over 40 years, embedded within the west -side neighborhood. The proposed R -4 Zone District will allow an adult day care use as a Use by Review. FINANCIAL IMPACT None.
