ORDINANCE NO 7980
AN ORDINANCE VACATING THE UTILITY AND DRAINAGE
EASEMENTS LOCATED AT 1 HAYHURST AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The following described utility and drainage easements located at 1 Hayhurst
Avenue
ALL OF THE UTILITY AND DRAINAGE EASEMENTS BETWEEN LOTS 4
AND 5, BETWEEN LOTS 5 AND 7, BETWEEN LOTS 6 AND 7, AND
BETWEEN LOTS 7 AND 4, WITH THE EXCEPTION OF THE DRAINAGE
EASEMENT ALONG THE SOUTH PROPERTY LINE OF LOTS 7 AND 4,
ALL IN BLOCK 2, SOUTH PRAIRIE SUBDIVISION, FILING 2, COUNTY OF
PUEBLO, STATE OF COLORADO
are hereby vacated
SECTION 2.
Upon the recommendation by the Planning and Zoning Commission this Ordinance
is approved with the following conditions
1 Provide a Detention Pond Easement in the southeast corner of Lot 4 by a separate
instrument.
2 Approval contingent upon approval by the Zoning Board of Appeals of the special use
permit and administrative approval of the rearrangement of property boundaries
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval

AN ORDINANCE VACATING THE UTILITY AND DRAINAGE EASEMENTS LOCATED
AT 1 HAYHURST AVENUE
ISSUE
Shall City Council approve the proposed vacations to facilitate the development of a
mini - storage facility?
The Planning and Zoning Commission, at their January 14, 2009, Regular Meeting,
voted 6 -0 to recommend approval with the following conditions:
1. Provide a Detention Pond Easement in the southeast corner of Lot 4 by a separate
instrument.
2. Approval contingent upon approval by the Zoning Board of Appeals of the special
use permit and administrative approval of the rearrangement of property boundaries.
BACKGROUND
The applicants are proposing to construct a mini - storage facility on Lots 4 -7, Block 2 of
the South Prairie Subdivision. As proposed the mini - storage units will be built across
the existing lot lines and easements, which is not permissible. Therefore, a lot line
rearrangement and easement vacation must be completed prior to development. The
applicants propose to vacate the Utility and Drainage Detention Easements between
Lots 4 and 5, Lots 5 and 7, Lots 6 and 7 and Lots 7 and 4 with the exception of the
drainage easement along southern property line of Lots 4 and 7. Once the easement
vacation has been finalized City Staff will process the lot line rearrangement.
