The following described alley adjacent to Lots 10, 11, 12 and Lots 19, 20, 21 in Block 2, Irving Park Subdivision: A PORTION OF THE ALLEY IN BLOCK 2 IRVING PARK SUBDIVISION, PUEBLO CO. TO BE VACATED MORE PARTICULARLY DESCRIBED AS FOLLOWS; THE PORTION OF THE ALLEY BETWEEN LOTS 10, 11, 12 AND LOTS 19, 20, 21. are hereby vacated. SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE VACATING A PORTION OF THE ALLEY ADJACENT TO LOTS 10, 11, 12 AND LOTS 19, 20, 21 IN BLOCK 2, IRVING PARK SUBDIVISION GENERALLY LOCATED AT 2605 NORWICH AVENUE ISSUE Shall City Council approve the proposed alley vacation to alleviate the encroachment of the existing house at 2605 Norwich Avenue and to facilitate the proposed Special Area Plan? RECOMMENDATION The Planning and Zoning Commission, at their January 14, 2009, Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND The applicant wishes to vacate a portion of the alley adjacent to Lots 10 -12 and 19 -21, Block 2, Irving Park Subdivision. The purpose of the vacation is to alleviate the encroachment of the existing house at 2605 Norwich Avenue and to facilitate the proposed Special Area Plan. Mr. La Duke owns the parcel, which consists of Lots 1 -12 and 19 -21, Block 2 of the Irving Park Subdivision. A house has been constructed on Lots 10 -12 and encroaches approximately six feet into the alley. Mr. La Duke would like to develop the lots directly east of the existing house for residential purposes, which would block the current right -of -way access to the house. Therefore, a Special Area Plan has been proposed that will dedicate Lot 21 as access to the existing home and separate the large parcel into two residential parcels, Parcel A and Parcel B. The alley vacation is necessary to correct the current encroachment and to allow direct access, via Lot 21, to the existing home. The steep terrain and site conditions preclude the alley from being used as right -of -way. Because of this, the alley vacation should not have a negative impact on the surrounding neighborhood.
