HomeMy WebLinkAbout07968ORDINANCE NO. 7968 AN ORDINANCE AMENDING SECTION 8 OF CHAPTER I OF TITLE XV OF THE PUEBLO MUNICIPAL CODE RELATING TO AMENDMENTS TO THE MODEL TRAFFIC CODE AND CLARIFYING THAT SIGNATURE OF PEACE OFFICER ISSUING SUMMONS AND COMPLAINT INCLUDES SIGNATURE BY WAY OF PRINTED, STAMPED OR TYPEWRITTEN LAST NAME AND BADGE NUMBER OF PEACE OFFICER BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter deleted, underscoring indicates matter added) SFrTinN 1 Section 8 of Chapter I of Title XV of the Pueblo Municipal Code is hereby amended by the addition of a new subsection (a)(18.1) to read as follows: Sec. 15 -1 -8. Amendments and additions. (a) The following parts, sections or subsections of Article I of said Model Traffic Code are hereby repealed, added or amended to read as follows: (18.1) 1707. Summons and complaint or penalty assessment notice for traffic offenses - release - registration. (1) Whenever a person commits a violation of this Code other than a violation for which a penalty assessment notice may be issued in accordance with the provisions of section 1701 and C.M.C.R., and such person is not required by the provisions of section 1705 to be arrested and taken without unnecessary delay before a municipal judge, the peace officer may issue and serve upon the defendant tTi i the defendant's driver's license, if any, a citation of the code alleged to have been violated, a brief description of the offense, the date and servea on the aetenaant: snau airect the aetenaant to appear in a specinea court at a specified time and place; shall be signed by the peace officer, either handwritten or by way of printed, stamped or typed last name and badge number of the peace officer; and shall contain a place for the soecinea in the summons portion or the summons SECTION 2. SECTION 2. This Ordinance shall become effective upon final passage and approval. RECOMMENDATION The City Council should pass and approve the proposed Ordinance. BACKGROUND The proposed Ordinance clarifies that a summons and complaint for a traffic code violation can be signed by a peace officer by way of printed, stamped or typed last name and badge number of the peace officer. This is the preferred method of signature for use with the City's Sun Gard OSSI record management system. FINANCIAL IMPACT None
