The zoning restrictions covering the following described property be changed from R -4, Mixed Residential District, to B -1, Neighborhood Business District, and upon passage of this Ordinance, zoning restrictions affecting B -1, Neighborhood Business District, shall apply to said property as follows: Lots 37 -42, Block 10 of the Sunny Heights Subdivision. Containing.43 acres, more or less SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -4, MIXED RESIDENTIAL DISTRICT, TO B -1, NEIGHBORHOOD BUSINESS DISTRICT ISSUE Shall City Council approve a request to rezone the property from R -4, Mixed Residential District, to B -1, Neighborhood Business District? RECOMMENDATION The Planning and Zoning Commission, at their November 12, 2008 Regular Meeting, voted 4 -1 to recommend approval. BACKGROUND The applicant is requesting to rezone a .43 -acre parcel located at 807 San Angelo Street from R -4 to B -1 in order to promote redevelopment of the property. The parcel consists of Lots 37 -42, Block 10 of the Sunny Heights Subdivision, Filing No. 2. The subject property was originally zoned R -3, One and Two Family Residential, a Special Use Permit was issued in 1976 to allow a church to operate at this address. In 2001, the property was rezoned to a R -4, Mixed Residential Zone District and a Special Use Permit was issued to allow a Day Care Center. A third Special Use Permit was issued in 2003 to allow a "Charitable Organization," which operated as a facility that provided care for adults with disabilities. The historical use of the property is non - residential. The applicant intends to establish a "meal preparation service," which has been defined as a retail use. Retail uses are allowed by Special Use Permit in the B -1, Neighborhood Business District, the applicant has received a Special Use Permit contingent upon approval of the rezoning request (ZBA -76- 2008).
