AN ORDINANCE VACATING ALL OF THE PUBLIC UTILITY
AND INGRESS /EGRESS EASEMENTS IN THE
"TOWNHOME" DISTRICT AND ALL PUBLIC UTILITY
EASEMENTS AND DRAINAGE EASEMENTS ADJACENT TO
LOTS 1 -4, BLOCK 4, LOTS 1 -5 BLOCK 5 AND LOTS 1 -5
BLOCK 7 WITHIN THE BELLA VISTA SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The following described public utility, ingress /egress and drainage easements:
All of the Drainage and Public Utility Easements in Lots 1, 2, 3 and 4, Block
4,
K
All of the Drainage and Public Utility Easements in Lots 1, 2, 3, 4 and 5,
Block 5
AND
All of the Public Utility Easements in Lots 1, 2, 3, 4 and 5, Block 7

All of the Public Utility and Ingress /Egress Easements in Parcel K
AND
All of the Public Utility Easements in Parcel L

ISSUE
Shall City Council approve vacating the public utility, ingress /egress and drainage
easements located within the Bella Vista Subdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their November 12, 2008, regular meeting
voted 5 -0 to recommend approval.
BACKGROUND
The applicant wishes to vacate all of the dedicated Public Utility Easements and
Ingress /Egress Easements in the "Townhome" district and all Public Utility Easements
and Drainage Easements adjacent to Lots 1 -4, Block 4, Lots 1 -5 Block 5 and Lots 1 -5
Block 7 within the Bella Vista Subdivision. The purpose of the vacation is to facilitate
the Bella Vista Subdivision, Filing No. 2. The resubdivision proposes to replace a
majority of the "Townhome" District with one large lot for the development of an assisted
living complex and to increase the number of residential lots for single - family detached
residences. The second filing includes necessary Public Utility, Drainage, and
Ingress /Egress Easements.
