AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM PUEBLO COUNTY A -1, AGRICULTURAL ONE
DISTRICT, TO CITY OF PUEBLO S -1, GOVERNMENTAL
USE DISTRICT COVERING A PARCEL OF LAND
GENERALLY LOCATED EAST OF INTERSTATE 25 AND
NORTH OF LIME ROAD
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed
from Pueblo County A -1, Agricultural One to City of Pueblo S -1, Governmental Use
District, and upon passage of this Ordinance, zoning restrictions affecting S -1,
Governmental Use District, shall apply to said property as follows:
A PORTION OF LAND SITUATED IN THE SOUTH ONE -HALF OF SECTION 2,
TOWNSHIP 22 SOUTH, RANGE 65 WEST OF THE 6 PRINCIPAL MERIDIAN,
COUNTY OF PUEBLO, STATE OF COLORADO, BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
BASIS OF BEARINGS THE NORTH LINE OF THE NORTHEAST ONE -
QUARTER OF SECTION 2, TOWNSHIP 22 SOUTH, RANGE 65 WEST
OF THE 6 PRINICIPAL MERIDIAN BEING MONUMENTED AT THE
NORTH ONE - QUARTER CORNER OF SAID SECTION 2 BY A
RECOVERED 6 INCH BY 6 INCH CONCRETE POST WITH A
CHISELED CROSS AND AT THE NORTHEAST CORNER OF SAID
SECTION 2 BY A RECOVERED 3 -1/4 INCH ALUMINUM CAP STAMPED

SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

INTERSTATE 25 AND NORTH OF LIME ROAD
ISSUE
Shall City Council approve a request to rezone the property from Pueblo County A -1,
Agricultural One District, to City of Pueblo S -1, Governmental Use District, to facilitate
the construction of a Board of Water Works elevated potable water storage tank?
RECOMMENDATION
The Planning and Zoning Commission, at their October 16, 2008 Special Meeting, voted
6 -0 to recommend approval of the rezoning and the development plan with the condition
that prior to completion of the Greenhorn Tank construction that final landscaping,
lighting and fencing plans be reviewed and approved by the Planning and Zoning
Commission.
BACKGROUND
To facilitate the development of the Vestas Towers America ( "Vestas ") project, and the
future St. Charles Industrial Park, Vestas conveyed to the City a 5 -acre parcel (the
"Tank Site ") to locate a potable water storage tank. The Tank Site is generally located
2,400 feet east of Interstate 25 immediately north of Lime Road. On October 14, 2008,
City Council approved Ordinance No. 7900 annexing the Tank Site into the corporate
limits. Within 90 days from the effective date of the annexation, and prior to any
development, annexed lands must be zoned under the City's Zoning Ordinance. The
City, on behalf of the Board of Water Works, makes this request for zoning and
development plan approval to facilitate the construction of a 1.5 million gallon elevated
potable water storage tank (the "Greenhorn Tank ") on the City owned Tank Site.
