AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM
S -1, GOVERNMENT USE DISTRICT, TO AN 1 -2, LIGHT
INDUSTRIAL DISTRICT COVERING A PARCEL OF LAND
COMMONLY KNOWN AS 1035 EAST NORTHERN AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed
from S -1, Government Use District, to 1 -2, Light Industrial District, and upon passage of
this Ordinance, zoning restrictions affecting 1 -2, Light Industrial District, shall apply to
said property as follows:
COMMENCING at the southeast corner of the said Northeast Y4 of the
Southwest Y4, thence north along the east line of said Northeast Y4 of the
Southwest Y4, a distance of 123.00 feet to the POINT OF BEGINNING;
thence west and perpendicular to the said east line, a distance of 267.00
feet; thence north and parallel to said east line, a distance of 400.00 feet;
thence east and perpendicular to said east line, a distance of 267.00 feet
to a point on the said east line of said Northeast Y4 of the Southwest Y4;
thence south and along said east line, a distance of 400.00 feet to the
POINT OF BEGINNING.
Said parcel contains 2.46 acres, more or less
and more commonly known as:
1035 East Northern Avenue
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve a request to rezone the property from S -1, Government Use
District, to an 1 -2, Light Industrial District?
RECOMMENDATION
The Planning and Zoning Commission, at their October 8, 2008 Regular Meeting, voted
6 -0 to recommend approval.
BACKGROUND
The applicant owns an 11.75 -acre parcel located approximately 580 feet north of
Northern Avenue that is currently zoned 1 -3 with an island of S -1 located in the middle of
the parcel. Prior to December 2001, the area of S -1 zoning stretched to the north and
east encompassing Lots 9 -16, Block 89 and Lots 4 -14, Block 99 of the Riverside Park
Subdivision. This area was rezoned in 2001 under the premise that the S -1 Zone
District was most likely associated with a privately owned, non - operational, swimming
pool located approximately 300 -feet east of the S -1 District. Therefore, the property
was rezoned with the assumption that the entire S -1 Zone District was zoned in error.
The current rezoning case parallels the previous request. The applicant is seeking to
rezone the remnant portion of S -1 property so that it can be used for private industrial
use in conjunction with the remainder of the parcel. Properties to the north, east, south
and west are all zoned for industrial use. The rezoning would correct a zoning error and
create a usable parcel for the property owner.
