The zoning restrictions covering the following described property be changed from R -3, One and Two Residential District to RCN, Residential Charter Neighborhood, and upon passage of this Ordinance, zoning restrictions affecting RCN, Residential Charter Neighborhood, shall apply to said property as follows: Lot 1 & 2, Block 3, Lakewood Subdivision and more commonly known as: 900 Berkley Avenue RFr.T1nNV 9 This Ordinance shall become effective immediately upon final passage and approval. RECOMMENDATION The Planning and Zoning Commission, at their October 8, 2008 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND The applicant is requesting to rezone 900 Berkley Avenue to function as a live work arrangement encompassing a residence and two occupations. Upon approval of the rezoning the applicant will apply for a Special Use Permit from the Zoning Board of Appeals (ZBA) to allow a jewelry sales and repair business as well as a certified massage therapy operation. The property in question is a historic neighborhood commercial structure measuring 2,489 square feet, which was erected between 1915 and 1925. The property contained a grocery store in 1925 and maintained a commercial use until 2006. During the 1968 Citywide rezoning the property was changed to a R -3 Zone District, causing the commercial use to become non - conforming. A nonconforming use certificate was issued for a TV repair, dance studio, and three - plex apartment until 2006 when it was discontinued. To operate as a live work unit the property will have to make some additional physical upgrades detailed in a Memo from Pepper Whittlef. The storage trailer will also have to be removed from the yard. The site improvements will be added as conditions to the Zoning Board of Appeals Staff report. FINANCIAL IMPACT None.
