The zoning restrictions covering the following described property be changed from R -2, Single - Family Residential, to B -4, Regional Business District, and upon passage of this Ordinance, zoning restrictions affecting B -4, Regional Business District, shall apply to said property as follows: West 40 feet of the North 100 feet of the South 400 feet of the SEY4 of the NWY4 of Section 13, T -20 -S, R -65 -W, of the 6 P. M., County of Pueblo, State of Colorado. and more commonly known as: 4055 Club Manor Drive SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, SINGLE - FAMILY RESIDENTIAL DISTRICT, TO B -4, REGIONAL BUSINESS DISTRICT COVERING A PARCEL OF LAND COMMONLY KNOWN AS 4055 CLUB MANOR DRIVE ISSUE Shall City Council approve a request to rezone the property from R -2, Single - Family Residential, to B -4, Regional Business District? RECOMMENDATION The Planning and Zoning Commission, at their October 8, 2008 Regular Meeting, voted 5 -0 -1 to recommend approval. BACKGROUND The applicant is requesting to rezone a 4,000 square foot section of unplatted land that makes up the western portion of the parcel located at 4049 Club Manor Drive. The parcel consists of Lot 3, College Road Shopping Center Subdivision, Filing #2, which was subdivided in 1976, and a four -foot by 100 -foot section of unplatted land. Lot 3 is zoned B -4 and the unplatted portion of the parcel is zoned R -2. Mr. Schuster was granted a Special Use Permit (Z- 08 -20) for a warehousing use in the B -4 District on June 24, 2008. In order for the business to use the western portion of the parcel for parking, that area must be rezoned to B -4, which will allow parking as an accessory use to the principal warehousing use. The rezoning will also clean up the multi -zoned property mitigating possible land use issues in the future. FINANCIAL IMPACT None.
