SECTION 1. Section 17 -4 -51 (11.1) c. of the Pueblo Municipal Code is hereby amended to read as follows: c. Uses by review: A use by review is any of the following uses, which are permitted only upon issuance of a special use permit: 1. Bulk Storage, warehousing or wholesaling. 1.1 Community correctional facility or program. 1.2 Homeless shelter. 2. Private recreation and amusement facilities. 3. Mobile home sales. 4. Tower (antenna). 5. Crematory. 6. Residence, multi - family. 7. Veterinary hospital. SECTION 2. Section 17 -4 -51 (12) c. of the Pueblo Municipal Code is hereby amended to read as follows: c. Uses by review: A use by review is any of the following uses, which are permitted only upon issuance of a special use permit: 1. Bulk storage; warehousing or wholesaling. 2. Community correctional facility or program. 3. Homeless shelter. 4. Private recreation and amusement facilities. 5. Tower (antenna). 6. Crematory. 7. Residence, commercial, apartments, or condominiums. 8. Veterinary hospital. SECTION 3. This Ordinance shall become effective upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO USES BY REVIEW IN B -3 AND B -4 ZONE DISTRICTS ISSUE Should the City Council amend Chapter 4 of Title XVII of the Pueblo Municipal Code to include veterinary hospital as a use by review in the Highway and Arterial Business District (B -3) and the Regional Business District (B -4)? RECOMMENDATION The Planning and Zoning Commission, at their October 8, 2008 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND Presently, a veterinary hospital is only allowed as a use by right in the Agricultural One (A -1), Agricultural Two (A -2), Multiple - Residential and Commercial District (R -6), Light Industrial (1 -2) and Heavy Industrial (1 -3) Zone Districts. It has come to the attention of the Planning and Community Development Department that a great deal of existing veterinarian hospitals currently reside as legal non - conforming uses in districts other than those mentioned above. The Pueblo Small Animal Clinic, submitted a letter dated June 10, 2008 requesting that zoning restrictions on veterinary hospitals be revisited because of the limited access and land available in the aforementioned zone districts. Additionally, many clinics specialize in domestic pet care, which lends itself to being readily accessible to urban residential areas. Staff has reviewed the request and does not foresee negative impacts stemming from allowing veterinary hospitals, by special review, in the B -3 or B -4 Zone Districts as these districts are reserved for general services which serve the public good.
