The zoning restrictions covering the following described property be changed from B -1, Neighborhood Business District to B -4, Highway and Arterial Business District, and upon passage of this Ordinance, zoning restrictions affecting B -4, Highway and Arterial Business District, shall apply to said property as follows: Lot 11, Block 93, Conley's Addition and more commonly known as: 601 East 8 Street SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -1, NEIGHBORHOOD BUSINESS DISTRICT TO B -4, HIGHWAY AND ARTERIAL BUSINESS DISTRICT COVERING A PARCEL OF LAND COMMONLY KNOWN AS 601 EAST 8 STREET ISSUE Shall City Council approve a request to rezone the property from R -5, Multiple Residential and Office District to B -4, Regional Business District, to bring the parcel and existing structure into conformance with City Zoning regulations? RECOMMENDATION The Planning and Zoning Commission, at their September 10, 2008 Regular Meeting, voted 5 -0 to recommend approval. BACKGROUND The applicant is requesting to rezone 601 East 8th Street to expand the existing automotive repair use on to the subject lot. Hinkle Fleet and Auto currently resides on Lots 9 and 10, Block 93, Conley's Addition. The applicant has filed for a rearrangement of property boundaries, which will combine Lots 9, 10 and 11 into one development parcel. Lots 9 and 10 are zoned B -4, Regional Business District, Lot 11 is zoned B -1, Neighborhood Business District, and must therefore be rezoned to match the adjacent B -4 and to allow an auto service station as a use by right.
