HomeMy WebLinkAbout07888ORDINANCE NO. 7888 AN ORDINANCE AMENDING SECTION 7 OF CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO LANDSCAPE PLAN REQUIREMENTS WHEREAS, in 2007, the Colorado legislation enacted the Landscape Architects Professional Licensing Act (the "Act "). WHEREAS, the Act specifies that on and after January 1, 2008, a person shall not practice landscape architecture or represent himself or herself as a landscape architect unless the person has a license issued by the State Board of Landscape Architects. WHEREAS, the Act requires that on and after January 1, 2008, landscape design services (except residential landscape design for single - family and multi - family residential properties of four or fewer units not including common areas) must be performed and landscape plans must be stamped by a licensed landscape architect. BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicating matter being added) SECTION 1 Section 17- 4- 7(b)(7) of the Pueblo Municipal Code is hereby amended by the addition of the following new paragraph (e) to read as follows: e. The landscape plan shall be prepared and stamped by a Colorado licensed landscape architect except landscape plans for single and multi - family residential properties of four or fewer units not including common areas. RECOMMENDATION The Planning and Zoning Commission, at their August 13, 2008 Regular Meeting, voted 6 -1 to recommend approval. This Act specifies that on and after January 1, 2008, a person shall not practice landscape architecture or represent himself as a landscape architect unless the person has a license issued by the State Board of Landscape Architects. The Act requires that landscape plans (except residential landscape design for single - family and multi - family residential properties of four or fewer units not including common areas) must be prepared and stamped by a licensed landscape architect. The proposed text amendment will revise the City's Zoning Code to be consistent with the Act. FINANCIAL IMPACT None.
