The following described alley adjacent to Lots 7, 8, 9 and 13 of State Addition: All of the North one half of the alley adjacent to Lot 7 and all of the alley adjacent to Lot 8 and Lot 9 and the Westerly 1.5 feet of the South one half of the alley adjacent to Lot 10 and the South one half of the alley adjacent to Lot 13 all being in THE MAP OF STATE ADDITION TO PUEBLO, according to the recorded plat thereof, as filed for record on January 28, 1878 in the Pueblo County records. is hereby vacated. SECTION 2. PACHECO, DIRECTOR TITLE AN ORDINANCE VACATING THE REMAINING PORTIONS OF ALLEY ADJACENT TO LOTS 7, 8, 9 AND 13 OF STATE ADDITION GENERALLY LOCATED SOUTH OF 2 STREET, EAST OF ELIZABETH STREET AND WEST OF GREENWOOD STREET ISSUE Shall City Council approve the proposed vacation to facilitate future redevelopment of the property? The Planning and Zoning Commission, at their July 9, 2008, Regular Meeting, voted 6- 0 to recommend approval. BACKGROUND The applicant proposes to vacate the remaining portions of the alley adjacent to Lots 7, 8, 9 and 13 of State Addition to allow future redevelopment. The eastern portion of the alley was vacated March 13, 1978, in an attempt to facilitate development of the parcel. A second vacation occurred in 2007, which vacated a central portion of the alley adjacent to Lots 4, 5, 6, 10, 11 and 12. The following request will succeed in vacating the entire alley, including the western and central portions that were not vacated in the previous two vacations. The alley does not serve as public right -of -way; therefore the vacation will not pose a problem. FINANCIAL IMPACT None.
