AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM HB, HISTORIC BUSINESS
DISTRICT TO HARP -1, HISTORIC ARKANSAS RIVERWALK OF PUEBLO DISTRICT -ONE
COVERING A PARCEL OF LAND COMMONLY KNOWN AS 102 S. UNION AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from HB,
Historic Business District to HARP -1, Historic Arkansas Riverwalk of Pueblo District — One and
upon passage of this Ordinance, zoning restrictions affecting HARP -1, Historic Arkansas Riverwalk
of Pueblo District -One shall apply to said property as follows:
ALL OF LOTS 13, 14, 15 AND 16, BLOCK 60, IN THE FORMER TOWN OF SOUTH
PUEBLO, NOW PART OF THE CITY OF PUEBLO, ACCORDING TO THE RECORDED
PLAT THEREOF.
and more commonly known as:
102 S. Union Avenue.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from HB, Historic Business
District to HARP -1, Historic Arkansas Riverwalk of Pueblo District -One?
The Planning and Zoning Commission, at their July 9, 2008 Regular Meeting, voted 6 -0
to recommend approval.
On November 9, 2006, the Pueblo Architectural Review Board (PARB) approved the
site plan and elevations for the Riverview @ Union building based on conformance with
the Historic Business District Guidelines. This approval authorized a three -story
building with a mechanical penthouse. On September 13, 2007, the applicant
amended their plans and received approval from the PARB to increase the building to a
total of four stories, adding 3'-6" to the overall height of the building. After construction
began, it was discovered that the building was erroneously permitted at four stories tall.
The building is in the Union Avenue Historic District but is considered a non-
contributing structure.
