HomeMy WebLinkAbout07847ORDINANCE NO. 7847 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM PUEBLO COUNTY R -1, TO CITY OF PUEBLO R -4, MIXED RESIDENTIAL DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED NORTH OF KINGSROYAL BOULEVARD AND WEST OF NEWMARKET STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from Pueblo County R -1, to City of Pueblo R -4, Mixed Residential District, and upon passage of this Ordinance, zoning restrictions affecting R -4, Mixed Residential District, shall apply to said property as follows: A parcel of land located in a portion of the SE Y4 of Section 9, Township 21 South, Range 65 West of the 6 th P.M. in the County of Pueblo and State of Colorado, and being more particularly described as follows: R -1 TO R -4 All of Lots 32, 33, 34 and 35, Block 16 and the vacated alley and vacated Shull Avenue adjacent to Lots 32, 33, 34 and 35, Block 16 all being in Columbia Heights according to the recorded plat thereof as filed for record May 23, 1888 in the Pueblo County Records and the North Y2 of Kingsroyal Boulevard as presently located adjacent to said Shull Avenue as platted in Regency Business Park, LLC. Containing 0.58 acres, more or less. and more commonly known as: Land generally located north of Kingsroyal Blvd and west of Newmarket Street. SECTION 2. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM PUEBLO COUNTY R- 1, TO CITY OF PUEBLO R-4, MIXED RESIDENTIAL DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED NORTH OF KINGSROYAL BOULEVARD AND WEST OF NEWMARKET STREET ISSUE Shall City Council approve a request to rezone the property from Pueblo County R -1, to City of Pueblo R4, Mixed Residential District, to facilitate residential development? RECOMMENDATION The Planning and Zoning Commission, at their June 11, 2008 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND Section 31 -12- 115(2) of the Colorado Revised Statutes requires all newly annexed land be brought under municipal. zoning regulations within 90 days of the effective date of annexation. Therefore, the applicants are requesting to rezone the .58 -acre Regency Business Park property from Pueblo County R -1 to City of Pueblo R-4. The R-4 designation will facilitate residential development and will comply with the Pueblo Comprehensive Plan. All adjacent property is also zoned R4. FINANCIAL IMPACT None.
