HomeMy WebLinkAbout07842ORDINANCE NO. 7842 AN ORDINANCE AMENDING CHAPTERS 2 AND 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO ADULT DAY SERVICE CENTERS BE IT ORDANIED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 Section 17 -2 -1 of the Pueblo Municipal Code is hereby amended by the addition of the following new paragraph (11.2) as follows: (11.2) Day service center, adult means a facility providing health and social services, individual therapeutic and psychological activities for the elderly and /or persons with disabilities for a portion of a 24 -hour day. Such facility may be operated with or without compensation for such services. A facility shall be properly licensed and /or certified as required by the State. SECTION 2 Section 17- 4- 51(6)(c) of the Pueblo Municipal Code is hereby amended by the addition of the following new paragraph (4.1) as follows: (4.1) Day service center, adult. SECTION 3 Section 17- 4- 51(7)(c) of the Pueblo Municipal Code is hereby amended by the addition of the following new paragraph (2.1) as follows: (2.1) Day service center, adult. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTERS 2 AND 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO ADULT DAY SERVICE CENTERS ISSUE Should the City Council amend Chapters 2 and 4 of Title XVII of the Pueblo Municipal Code relating to adult day service centers? The Planning and Zoning Commission, at their June 11, 2008 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND The proposed text amendment will create a new principal use by providing a definition and specific zone districts in which the use will be allowed. Currently, adult day service centers are not permitted in any zone district because there is no definition that accurately defines such use, and there are no zone districts that would allow the use. The use will be permitted as a use by review in Mixed Residential (R-4) and Multiple Residential (R -5) zone districts. FINANCIAL IMPACT None.
