HomeMy WebLinkAbout07814ORDINANCE NO. 7814 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM PUEBLO COUNTY A -1, AGRICULTURAL ONE ZONE DISTRICT TO CITY OF PUEBLO S -1, GOVERNMENT USE DISTRICT, COVERING A PARCEL OF LAND GENERALLY LOCATED NORTHWEST OF THE PUEBLO BOULEVARD AND HIGHWAY 50 INTERSECTION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from Pueblo County A -1, Agricultural One Zone District to City of Pueblo S -1, Government Use District, and upon passage of this Ordinance, zoning restrictions affecting S -1, Government Use District, shall apply to said property: A -1 TO S -1 A parcel of land located in a portion of the SW '/4 of Section 10 and the NW '/4 of Section 15, Township 20 South, Range 65 West of the 6 th P.M. in the County of Pueblo and State of Colorado and being more particularly described as follows: Considering the South line of the SW '/4 of Section 10, Township 20 South, Range 65 West of the 6 th P.M. to bear N. 88 0 47'58" E. and all bearings contained herein being relative thereto. Commencing at the SW corner of the SW' /4 of Section 10; thence N. 47 0 51'31" E., a distance of 187.04 feet to the Point of Beginning; thence N. 18 0 44'24" E., a distance of 28.77 feet to a point on the Northerly right -of -way line of U.S. Highway No. 50 as presently located; thence along the Northerly right -of -way line of said U.S. Highway No. 50 the following four (4) courses: 1. N. 77 0 29'39" E., a distance of 162.74 feet; 2. N. 67 0 53'39" E., a distance of 309.70 feet; 3. N. 10 0 48'39" E., a distance of 460.20 feet; 4. S. 74 0 31'34" E., a distance of 87.05 feet; thence S. 16 0 57'02" E., a distance of 285.85 feet; thence S. 06 0 37'53" E., a distance of 176.76 feet; thence S. 21 W., a distance of 335.62 feet; thence N. 74 0 48'18" W., a distance of 327.96 feet; thence N. 76 0 52'33" W., a distance of 297.42 feet to the Point of Beginning. Said Parcel contains 4.99 acres, more or less. and more commonly known as: Land generally located Northwest of the Pueblo Boulevard and Highway 50 Intersection. SECTION 2. This Ordinance is approved with the following conditions: Provide a site plan and elevations for all future site development following the initial development, which includes, but is not limited to, the future garage and sand shed. 2. Section 17 -4 -52 (b) (12) c. prohibits the use of wood poles for all outdoor lighting fixtures. Replace the light pole located closest to the proposed sand shed and secondary contaminant area with an alternate material. 3. In accordance with Section 17 -4 -52 (d) (3), provide Planning and Community Development Staff with photometric data for the site. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM PUEBLO COUNTY A- 1, AGRICULTURAL ONE ZONE DISTRICT TO CITY OF PUEBLO S -1, GOVERNMENT USE DISTRICT, COVERING A PARCEL OF LAND GENERALLY LOCATED NORTHWEST OF THE PUEBLO BOULEVARD AND HIGHWAY 50 INTERSECTION ISSUE Shall City Council approve a request to rezone the property from Pueblo County A -1, Agricultural One Zone District to City of Pueblo S -1, Government Use District, to facilitate the subdivision and development of the Highway 50 West CDOT Maintenance Facility? RECOMMENDATION The Planning and Zoning Commission, at their April 9, 2008 Regular Meeting, voted 7- 0 to recommend approval with the following conditions: 1. Provide a site plan and elevations for all future site development following the initial development, which includes, but is not limited to, the future garage and sand shed. 2. Section 174-52 (b) (12) c. prohibits the use of wood poles for all outdoor lighting fixtures. Replace the light pole located closest to the proposed sand shed and secondary contaminant area with an alternate material. 3. In accordance with Section 17 -4 -52 (d) (3), provide Planning and Community Development Staff with photometric data for the site. BACKGROUND This is the initial zoning of the property under the City's Zoning Ordinance, which will facilitate the subdivision and development of the Highway 50 West CDOT Maintenance Facility. The State proposes to construct a maintenance facility for their vehicles and equipment. Development in a S -1 Zone District must be reviewed and approved by the Planning and Zoning Commission. The applicant has provided a Development Plan that includes the placement of all immediate structures, landscaping and lighting for the site. FINANCIAL IMPACT None.
