HomeMy WebLinkAbout07802ORDINANCE NO. 7802 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -2, LIGHT INDUSTRIAL TO B -4, REGIONAL BUSINESS DISTRICT, COVERING A PARCEL OF LAND GENERALLY LOCATED AT THE SOUTHWEST CORNER OF WEST STREET AND 6 STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from 1 -2, Light Industrial to B -4, Regional Business District, and upon passage of this Ordinance, zoning restrictions affecting B -4, Regional Business District, shall apply to said property: A parcel of land located in a portion of State Addition to the City of Pueblo in the County of Pueblo and State of Colorado, and being more particularly described as follows: Considering the monument line in Elizabeth Street between 5 th Street and 6 th Street to bear N. 00 0 38'32" W. and all bearing contained herein being relative thereto. 1 -2 to B -4 Commencing at the monument at the intersection of 5 th Street and Elizabeth Street as presently located; thence N 86 0 37'42" W., a distance of 443.19 feet to the Point of Beginning, said point being on the centerline of 5 th Street and West Street as presently located; thence S. 89 0 22'16" W., along the Northerly right -of -way line of said 5 th Street, a distance of 144.60 feet to a point on the Southerly line of Lot 4, Block 22 in State Addition to the City of Pueblo a according to the recorded plat thereof as filed for record on January 28, 1878 in the Pueblo County records; thence N. 53 0 43'52" W., a distance of 25.78 feet to a point on the Westerly line of Lot 4, Block 22 in said State Addition to the City of Pueblo; thence N. 00 0 37'57" W., along the Westerly lines of Lot 4, Block 22 and Lot 3, Block 22 in said Addition to the City of Pueblo, a distance of 280.88 feet to a point on the centerline of 6 th Street as presently located; thence N. 89 0 25'27" E., along the centerline of said 6 th Street, a distance of 12.34 feet; thence S. 00 0 34'33" E., a distance of 40.00 feet to a point on the Northerly line of Lot 3, Block 22 in said State Addition to the City of Pueblo; thence S. 53 0 43'52" E., a distance of 141.21 feet to a point on the Easterly line of Lot 1, Block 22 in State Addition to the City of Pueblo; thence N. 89 0 22'03" E., a distance of 40.00 feet to the centerline of said West Street; thence S. 00 0 37'57" E., along the centerline of said West Street, a distance of 171.57 feet to the Point of Beginning. Said Parcel contains 0.79 acres, more or less. and more commonly known as: Land generally located at the Southwest corner of West Street and 6 th Street. SECTION 2_ This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM 1 -2, LIGHT INDUSTRIAL TO B-4, REGIONAL BUSINESS DISTRICT, COVERING A PARCEL OF LAND GENERALLY LOCATED AT THE SOUTHWEST CORNER OF WEST STREET AND 6 STREET ISSUE Shall City Council approve a request to rezone the property from 1 -2, Light Industrial to B-4, Regional Business District, to facilitate commercial redevelopment for the property located at the southwest corner of West Street and 6` Street? RECOMMENDATION The Planning and Zoning Commission, at their March 12, 2008 regular meeting, voted 7 -0 to recommend approval. BACKGROUND The applicant is requesting the Zoning Map Amendment to facilitate commercial redevelopment for the property located at the southwest corner of West Street and 6`" Street. According to the State Board of Land Commissioners, the current industrial zoning is outdated and would not promote compatible development with the surrounding area. The immediate area is a mixture of business and industrial zoned properties. A large B-4 Zone District is located to the east, south, and west of the property. It is the contention of the Board that future development of the area will focus on commercial land uses, therefore the area has changed to a degree that it is in the public's interest to rezone as a means to encourage redevelopment. FINANCIAL IMPACT None.
