AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM A -1, AGRICULTURAL ONE
DISTRICT AND R -2, SINGLE - FAMILY RESIDENTIAL DISTRICT, TO B -3, HIGHWAY AND
ARTERIAL BUSINESS DISTRICT, R2 -U, SINGLE - FAMILY RESIDENTIAL DISTRICT, R -3, ONE
AND TWO- FAMILY RESIDENTIAL DISTRICT, AND R -5, MULTIPLE - RESIDENTIAL AND OFFICE
DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED APPROXIMATELY 250'
SOUTH OF KACHINA DRIVE AND IMMEDIATELY NORTH AND WEST OF CENTENNIAL HIGH
SCHOOL
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed from A -1,
Agricultural One District and R -2, Single - Family Residential District, to B -3, Highway and Arterial
Business District, R2 -U, Single - Family Residential District, R -3, One and Two - Family Residential
District, and R -5, Multiple - Residential and Office District, and upon passage of this Ordinance,
zoning restrictions affecting B -3, Highway and Arterial Business District, R2 -U, Single - Family
Residential District, R -3, One and Two - Family Residential District and R -5, Multiple - Residential
and Office District, shall apply to said property as follows:
A -1 TO B -3
Beginning at the W '/4 Corner of Section 14, Township 20 South, Range 65 West of the 6th
P.M. thence S. 01 °34'18" E., along the West line of the SW' /4 of said Section 14, a distance
of 353.04 feet; thence N. 53 0 10'20" W., a distance of 433.61 feet; thence Northwesterly
along the arc of a curve to the left whose radius is 400.00 feet, a distance of 181.15 feet;
thence N. 79 0 07'12" W., a distance of 42.75 feet; thence N. 88 0 42'16" E., a distance of
543.78 feet to the Point of Beginning.

SECTION 2.
This Ordinance shall become effective immediately upon final passage and approval.

ISSUE
Shall City Council approve a request to rezone the property from A -1, Agricultural One
District and R -2, Single - Family Residential District, to B -3, Highway and Arterial
Business District, R2 -U, Single- Family Residential District, R -3, One and Two - Family
Residential District, and R -5, Multiple - Residential and Office District, to facilitate the
development of the land into approximately 18 acres of multi - family and/or office, 80
acres of single - family residential and 2 acres of commercial development?
The Planning and Zoning Commission, at their April 9, 2008 Regular Meeting, voted 7-
0 to recommend approval.
On March 12, 2008, P &Z approved the Garden District Overall Development Plan. In
conformance with the approved OPD, the applicant is proposing to rezone 100.70 -
acres of land from A -1 and R -2 to B -3, R2 -U, R -3 and R -5. The multiple district
rezoning will facilitate the development of the land into approximately 18 acres of multi-
family and/or office, 80 acres of single - family residential and 2 acres of commercial.
