HomeMy WebLinkAbout07798ORDINANCE NO. 7798 AN ORDINANCE AMENDING CHAPTER 10 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO SIGNS BE IT ORDANIED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicating matter being added) SECTION 1 Subsection (e) of Section 04 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended by the addition of the following new paragraph (5.1) as follows: (5.1) Electronic variable message (EVM) sign means a sign with a fixed or changing display /message composed of a series of lights that may be changed through electronic means. .q Fr.TInN 9 Paragraph (a) of Section 05 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended to read as follows: (a) Residential: R -1, R -2, R -3, R -4, R -8 SECTION 3 Paragraph (b) of Section 05 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended to read as follows: (b) Residential: [R -4, ] R -5 R -6 SECTION 4 Paragraph (d) of Section 05 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended to read as follows: (d) Nonresidential commercial use: [R -4] R -5, R -6 SECTION 5 Paragraph (e) of Section 05 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby deleted in its entirety: [ (e) Residential: R -4, R -5, RCN (hotel, B &B, daycare center and similar uses). SECTION 10 follows: Section 07 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended as (9) Signs in, over or above the public right -of -way without a revocable permit therefore. Exception: Wall mounted signs having a projection of not more than fifteen inches (15 ") and a minimum clearance of not less than eight feet (8'), and conforming to all other provisions of this Chapter. SECTION 11 Section 07 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended by the addition of the following new subsection (12) as follows: (12) Overly bright or glaring signs, which constitute a nuisance as defined by Section 7 -1 -1 (a) of the Pueblo Municipal Code (PMC) as determined by the Administrative Official. SECTION 12 Appendix A, Section 15 of Chapter 10, Title XVII of the Pueblo Municipal Code is hereby amended as follows: Districts 1, 2 and 3 of Appendix A are deleted in their entirety, and Districts 1, 2, 3, 4 and 5 attached hereto are adopted in substitution thereof. SECTION 13_ This Ordinance shall become effective upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTER 10 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO SIGNS ISSUE Should the City Council amend Chapter 10 of Title XVII of the Pueblo Municipal Code relating to signs? RECOMMENDATION The Planning and Zoning Commission, at their April 9, 2008 Regular Meeting, voted 7- 0 to recommend approval. BACKGROUND The proposed text amendment is the first major update to the Sign Code adopted in 2005. Changes will be made relative to electronic variable message (EVM) signs, the special "high- rise" sign districts, wall signs over the public right -of -way, and will make some minor amendments to clean up some previous errors in the text. FINANCIAL IMPACT None.
