DT0802 — DILLON FLYOVER, ACCEPTING AN $800,000 GRANT FROM THE FEDERAL HIGHWAY ADMINISTRATION (FHWA), AUTHORIZING THE TRANSFER OF $200,000 FROM PROJECT NO. CP0712 - DILLON DRIVE 1601 STUDY, ENTERING INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION (CDOT) AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME, AND BUDGETING & APPROPRIATING THE AMOUNT OF $1,000,000 INTO PROJECT NO. DT0802 — DILLON FLYOVER WHEREAS, THE City has received funding up to a maximum combined total amount of $5,427,000 from a Federal Highway Administration (FHWA) SAFETEA -LU earmark for the design and construction of a fly -over (with a possible future interchange) at Dillon Drive and Interstate 25, and; WHEREAS, the Colorado Department of Transportation (CDOT) under the auspices of the FHWA has authority over the interstate highways within Colorado and requires that an Interstate Access Permit be obtained for a proposed fly -over bridge at Dillon Drive, and; WHEREAS, the City and CDOT must enter into an intergovernmental agreement, a copy of which is attached and has been approved as to form by the City Attorney, and; WHEREAS, the City has previously approved for funding up to $200,000 for matching funds for said grant for the required studies and design, and; BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Capital Project No. DT0802 — Dillon Fly -over is hereby created and funds in the amount of $1,000,000 are budgeted and appropriated. SECTION 2. The grant from the Federal Highway Administration (FHWA) in the amount of $800,000 is hereby accepted and funds shall be deposited in Project No. DT0802. SECTION 3. The President of the City Council is hereby authorized to execute the Intergovernmental Agreement with the Colorado Department of Transportation on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. DT0802 — DILLON FLYOVER, ISSUE Should City Council accept a grant from the Federal Highway Administration (FHWA), create a capital project concerning the Dillon Drive /125 Flyover Study and Design, budget and appropriate grant funds from the Federal Highway Administration ($800,000) and from the General Fund Reserve Account ($200,000), and allow the City to enter into an intergovernmental agreement with CDOT. RECOMMENDATION Approval of this Ordinance. BACKGROUND This project will provide for the necessary studies and design work to obtain an "air- rights" permit from the Colorado Department of Transportation (CDOT) to allow for the future construction of a "flyover" Dillon Drive bridge above Interstate 25. FINANCIAL IMPACT A federal earmark has been appropriated from the FHWA's SAFETEA -LU funds for this project. This grant requires the local agency to commit to a 20% match in the amount of $200,000 for a total amount available of $1,000,000. On August 31, 2007, City Council approved Ordinance No. 7646 appropriating and authorizing the use of funds in the amount of $200,000. Funds from the North Pueblo Urban Renewal Project Tax Increment Financing (TIF) will be used to reimburse the matching funds as these become available.
