HomeMy WebLinkAbout07775ORDINANCE NO. 7775 AN ORDINANCE APPROVING COLORADO HERITAGE PLANNING GRANT CONTRACT CHPG #00180 — PUEBLO CITY /COUNTY URBAN SERVICE AREA BOUNDARIES, BETWEEN THE STATE OF COLORADO AND THE CITY OF PUEBLO, A MUNICIPAL CORPORATION, AND AUTHORIZING THE PRESIDENT OF CITY COUNCIL TO EXECUTE SAME WHEREAS, through Resolution 10826 dated October 10, 2006, the City of Pueblo submitted an application for a Colorado Department of Local Affairs Heritage Planning Grant for a project identifying urban growth areas surrounding the City; and WHEREAS, the State of Colorado, Department of Local Affairs, has approved $26,000 in Colorado Heritage Planning Grant funds for the identification of urban service areas; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ Contract CHPG #00180 — Pueblo City /County Urban Service Area Boundaries, between the State of Colorado for the use and benefit of the Department of Local Affairs and the City of Pueblo, A Municipal Corporation, a copy of which is attached hereto and incorporated herein, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of City Council is authorized to execute and deliver said Contract in the name of and on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk is directed to affix the Seal of the City thereto and attest same. The DOLA grant agreement was originally approved with a scope of work that was modified based on the discussions between the City and County staff during the development of the City and County Intergovernmental Agreement that established the funding commitments from each agency. DOLA agreed to the modifications in the scope of work for the project, but not before the term of the original grant had expired. In order for the project to be completed, the City will need to enter into a new grant agreement with the revised scope of work approved by the City, County and DOLA. The project's principal issues include: adoption of an intergovernmental agreement which will guide all urbanized growth within the North Pueblo Special Development Area. The agreement will address the following: Define and provide criteria for urbanized development within the North Pueblo Special Development Area. 2. Develop a policy that Pueblo County will not approve development mutually defined as urban, but refer it to the City of Pueblo or an existing urban service provider. 3. Develop criteria and best practices for infrastructure extensions in future urbanized areas. FINANCIAL IMPACT The Colorado Heritage Planning Grant is for $26,000 and includes local matching funds of $27,029, for a total project budget of $53,029. The project funds were budgeted and appropriated, as part of Ordinance No. 7593, approved May 27, 2007. The City's share of the project will be $15,057, which shall be transferred from the General Fund reserves. The Pueblo County Commissioners approved Resolution No. 08 -59 on February 19, 2008, an intergovernmental agreement with the City, committing $11,972 in matching funds for the project.
