AN ORDINANCE AMENDING CHAPTER 1 OF TITLE XV OF THE PUEBLO MUNICIPAL CODE
RELATING TO THE SCHOOL CROSSING GUARD SURCHARGE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicated text
deleted, underscoring indicates text added)
SECTION 1.
Subsection 5 of Section 6, Chapter 1 of Title XV of the Pueblo Municipal Code is hereby
amended to read as follows:
(5) In addition to the penalties provided herein, any person convicted of a municipal
traffic violation for which points may be assessed by the Colorado Department of Revenue, other
than [a parking violation and] violations of the provisions of Sections 1412, 1415 or 221 of the
Model Traffic Code, shall be assessed a fee to be known as the school crossing guard surcharge
in the amount of ten dollars ($10.00)[.] provided, however that any person convicted of a
parking violation shall, in addition to the penalties provided herein, be assessed a fee to be
known as the school crossing guard surcharge in the amount of four dollars ($4.00). The
school crossing guard surcharge shall be imposed at the time of conviction and may not be
suspended or waived by the Court. For purposes of this Subsection, conviction shall include [all]
guilty pleas, no contest pleas, findings of guilt and deferred sentences entered on any such traffic
violation or parking violation The school crossing guard surcharge shall be collected by the
Municipal Court and paid into the City's general fund.
SECTION 2.
This Ordinance shall become effective April 1, 2008.

ISSUE
Should the City Council institute a surcharge of four dollars ($4.00) on all parking tickets
to supplement the existing school crossing guard fund?
RECOMMENDATION
Approval of recommendation
BACKGROUND
Currently a school crossing guard surcharge of ten dollars ($10.00) is assessed to all
moving violations, generating approximately $40,000 per year. The Transportation
Department is budgeted $66,000 ($26,000 subsidized by the general fund) a year to
reimburse SRDA to provide 12 school crossing guards to be placed at high risk
locations. High risk locations, determined by Transportation Department, throughout
the City are evaluated and ranked on criteria including the number of children crossing,
speed and volume of traffic, number of accidents at a location, roadway crossing width,
type of traffic control device, etc. The highest locations constitute the greatest risk
thereby dictating where the guards are stationed.
FINANCIAL IMPACT
Adding a four dollar ($4.00) surcharge to all parking tickets would generate
approximately $44,000 a year. The school crossing guarding program could add an
additional three crossing guard positions and would become completely self - supporting,
thus adding $26,000 back to the general fund.
