AN ORDINANCE VACATING A PORTION OF TROYAVENUE
AND THE SIDEWALK EASEMENT WITHIN THE PLATTED
UNIVERSITY VILLAGE SUBDIVISION, FILING NO. 2, A
SPECIAL AREA PLAN
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1.
The following described portion of Troy Avenue and existing sidewalk easement:
All of Troy Avenue as depicted on the plat of "University Village Subdivision ", Filing No. 2,
A Special Area Plan, according to the recorded plat thereof filed for record in the office of
the Pueblo County Clerk and Recorder on March 6, 2001 at Reception No. 1372500 more
particularly described as lying North of the South line of Section 16 & Section 17,
Township 20 South, Range 64 West of the 6' Principal Meridian, County of Pueblo, State
of Colorado, except the following described property:
Beginning at the Southwest corner of said Section 16, described as a 3W aluminum cap
stamped PLS 35593, said point being the Point of Beginning;
1. Thence S 88 08' 32" W, a distance of 50.00 feet along the South line of the
Southeast 1/4 of said Section 17.
2. Thence N 01 a 51'38"W, along the Westerly Right of Way line of said Troy Avenue,
a distance of 196.08 feet to a point on a non - tangent curve to the right having a
radius of 1300.00 feet.
3. Thence along said curve to the right an arc distance of 353.25 feet through a
central angle of 15 34'08", to a point on the Easterly Right of Way line of said Troy
Avenue.
4. Thence S 01 51'38" E along the Easterly Right of Way line of said Troy Avenue, a
distance of 534.72 feet to a point on the South line of said Section 16.
5. Thence S 89 15'18n W along the South line of said Section 16, a distance of 50.00
feet to the Point of Beginning.
The above described excepted parcel contains 0.90 acres (39,306 sq. ft.), more of less.
Basis of Bearings: Bearings are based on the South line of the SW %, of Section 16,
Township 20 South, Range 64 West of the 61h P.M., Found monuments being the
Southwest corner of Section 16, (31/4" Aluminum cap PLS35593) and the South %comer
of Section 16 (31/4" Aluminum cap PLS35593) which bears S 89e 15' 18" W.
is hereby vacated.

This Ordinance shall become effective immediately upon final passage and

AN ORDINANCE VACATING A PORTION OF TROY AVENUE AND THE SIDEWALK
EASEMENT WITHIN THE PLATTED UNIVERSITY VILLAGE SUBDIVISION, FILING
NO. 2, A SPECIAL AREA PLAN
ISSUE
Shall City Council approve the proposed vacation of a portion of Troy Avenue and the
sidewalk easement within the platted University Village Subdivision, Filing No. 1, A
Special Area Plan?
The Planning and Zoning Commission, at their January 9, 2008, regular meeting, voted
7 -0 to recommend approval.
The applicant proposes to vacate a portion of Troy Avenue and the sidewalk easement
within the platted University Village Subdivision, Filing No. 1, A Special Area Plan. The
planned roadway has not been built and will be realigned farther to the east as part of
the Villa Bella Subdivision, Filing No. 1. The sidewalk easement will no longer be
required because the right -of -way for Troy Avenue will be replatted large enough to
encompass the proposed sidewalk.
