HomeMy WebLinkAbout07755ORDINANCE NO. 7755 AN ORDINANCE EXTENDING THE TERM OF THE CURRENT COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE PUEBLO ASSOCIATION OF GOVERNMENT EMPLOYEES AND FIXING COMPENSATION FOR 2009 FOR ALL CITY OF PUEBLO EMPLOYEES IN THAT BARGAINING UNIT WHEREAS, the City of Pueblo and the Pueblo Association of Government Employees are parties to a collective bargaining agreement with a term beginning January 1, 2008 and ending December 31, 2008; and WHEREAS, that Agreement provides in Article 32 that the term of the Agreement may be extended by the City for one successive one year term; and WHEREAS, that Agreement further provides that the decision to extend the term of the Agreement shall be made by City Council on or before the 15 day of March 2008. The extended term shall be upon the same terms and conditions, except that wages during the extended term shall be as set forth in Article 15 of the Agreement; and WHEREAS, Article 15 of the Agreement provides that the monthly pay rate during the extended term shall be increased by 2.85% over the amount set by ordinance for the preceding year; and WHEREAS, section 3 -17 of the City Charter requires that every Council act fixing compensation shall be by ordinance; and WHEREAS, Article 10 section 20 of the Constitution of Colorado (the "Tabor Amendment ") could be interpreted to require that compensation for each year of the Pueblo Association of Government Employees (PAGE) collective bargaining agreement be authorized by a separate ordinance; therefore, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ The term of the current collective bargaining agreement by and between the City of Pueblo and the Pueblo Association of Government Employees is hereby extended through December 31, 2009 on the same terms and conditions contained therein, provided that wages beginning January 1, 2009 shall be as set forth in Article 15 of the Agreement. SECTION 2. Commencing January 1, 2009 and ending December 31, 2009, the monthly pay rate for each class, grade, step, or position of employees covered by said Agreement shall be increased by 2.85% over the amount set by ordinance for 2008. SECTION 3. This Ordinance shall become effective upon final passage and approval. City Administration recommends approval. BACKGROUND The collective bargaining agreement between the City of Pueblo and the Pueblo Association of Government Employees for 2008 will expire December 31, 2008. Pursuant to the terms of the Agreement, the City may extend the agreement for one successive one -year term, i.e. January 1, 2009 through December 31, 2009 (the "Extended Term "). The Extended Term shall be upon the same terms and conditions of the current agreement except that wages shall be increased by 2.85 %. If the City elects to extend the agreement, such decision must be made on or before March 15, 2008. If the City does not elect to extend the agreement, the union may commence negotiations for a successor agreement. FINANCIAL IMPACT If extended, the wage increases in 2009 will cost approximately $429,000 If not extended, wages shall be subject to negotiations.
