HomeMy WebLinkAbout07750ORDINANCE NO. 7750 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -1, NEIGHBORHOOD BUSINESS DISTRICT, TO CCN, COMMERCIAL CHARTER NEIGHBORHOOD COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1001 EAST EVANS AVENUE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1 _ The zoning restrictions covering the following described property be changed from B -1, Neighborhood Business District, to CCN, Commercial Charter Neighborhood, and upon passage of this Ordinance, zoning restrictions affecting B -1, Neighborhood Business District, to CCN, Commercial Charter Neighborhood, shall apply to said property: The North Y2 of Lot 35, Block 4, Bessemer Subdivision and more commonly known as: 1001 East Evans Avenue SECTION 2. The Ordinance is approved upon the following conditions: 1. Prior to the issuance of any building permit, additional parking and streetscape will be improved on Summit Ave as determined by the City of Pueblo. 2. Any proposed structural modifications will meet the minimum requirements of the Commercial Charter Neighborhood zone without variance. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM B -1, NEIGHBORHOOD BUSINESS DISTRICT, TO CCN, COMMERCIAL CHARTER NEIGHBORHOOD COVERING A PARCEL OF LAND COMMONLY KNOWN AS 1001 EAST EVANS AVENUE ISSUE Shall City Council approve a request to rezone the property from B -1, Neighborhood Business District, to CCN, Commercial Charter Neighborhood, to accommodate for a proposed future single - family residential addition and to achieve conformity of the current land use to an appropriate zone district? RECOMMENDATION The Planning and Zoning Commission, at their January 9, 2008 regular meeting, voted 6 -0 -1 (Pelto abstaining) to recommend approval with the following conditions: 1. Prior to the issuance of any building permit, additional parking and streetscape will be improved on Summit Ave as determined by the City of Pueblo. 2. Any proposed structural modifications will meet the minimum requirements of the Commercial Charter Neighborhood zone without variance. BACKGROUND This request to rezone to CCN is being made to accommodate for a proposed future single - family residential addition and to achieve a higher zoning compliance with the existing use. The property currently serves as Mr. Zook's combined residence and office. The Commercial Charter Neighborhood would allow the vertically mixed residential and commercial use by right. The Commercial Charter Neighborhood also allows for 100% lot coverage which is more appropriate for many historic commercial areas that were built before current zoning standards were applied. FINANCIAL IMPACT None.
