HomeMy WebLinkAbout07749ORDINANCE NO. 7749 AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, SINGLE FAMILY RESIDENTIAL DISTRICT, TO R -2U, SINGLE FAMILY RESIDENTIAL DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED EAST OF KINGFISHER DRIVE, NORTH OF CRESTED HILL AND WEST OF LAPWING COURT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property be changed from R -2, Single Family Residential District, to R -2U, Single Family Residential District, and upon passage of this ordinance, zoning restrictions affecting R -2, Single Family Residential District to R -2U, Single Family Residential District, shall apply to said property: A parcel of land located in a portion of Eagleridge Estates, Filing No. 2 in the County of Pueblo and State of Colorado, and being more particularly described as follows: Considering the East line of the NE '/4 of Section 11, Township 20 South, Range 65 West of the 6th P.M. to bear N. 00 0 31'24" W., and all bearings contained hereon being relative thereto. R -2 to R -2U Commencing at the NE corner of said Section 11; thence S. 65 0 17'48" W., a distance of 1760.72 feet to the Northwest corner of Lot 1, Block 1 in Eagleridge Estates, Filing No. 2 according to the re- recorded plat as filed for record at Reception No. 1702444 in the Pueblo County records and the Point of Beginning; thence N. 61 E., a distance of 549.06 feet; thence S. 00 0 00'49" W., a distance of 600.00 feet; thence S. 52 0 12'10" W., a distance of 212.38 feet; thence N. 34 0 37'39" W., a distance of 483.76 feet; thence Northerly along the arc of a curve to the right whose radius is 300.00 feet a distance of 33.92 feet; thence N. 28 0 08'57" W., a distance of 50.04 feet to the Point of Beginning. Containing 4.76 acres, more or less and more commonly known as: Lots 1 -14, Block 1; Lots 1 -4, Block 2, Eagleridge Estates, Filing No. 2 SECTION 2_ This Ordinance shall become effective immediately upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -2, SINGLE FAMILY RESIDENTIAL DISTRICT, TO R -21-1, SINGLE FAMILY RESIDENTIAL DISTRICT COVERING A PARCEL OF LAND GENERALLY LOCATED EAST OF KINGFISHER DRIVE, NORTH OF CRESTED HILL AND WEST OF LAPWING COURT ISSUE Shall City Council approve a request to rezone the property from R -2, Single Family Residential District to R -2U, Single Family Residential District, to correct an oversight that occurred during the original rezoning and subdivision? RECOMMENDATION The Planning and Zoning Commission, at their December 12, 2007 regular meeting, voted 6 -0 to recommend approval. BACKGROUND This rezoning request would correct an oversight that occurred during the concurrent rezoning and subdivision. Currently the zoning map and the subdivision do not match each other and as a result, a number of parcels are technically in two zone districts. This request would clarify the entire subdivision as one zone (R -2U). FINANCIAL IMPACT None.
