AN ORDINANCE CHANGING ZONING RESTRICTIONS FROM R -5, MULTIPLE — RESIDENTIAL
AND OFFICE DISTRICT, TO B -3, HIGHWAY AND ARTERIAL BUSINESS DISTRICT COVERING
A PORTION OF PARK WEST BUSINESS CAMPUS FILING #5, GENERALLY LOCATED NEAR
THE INTERSECTION OF SPAULDING AVENUE AND 31 STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The zoning restrictions covering the following described property be changed from R -5, Multiple -
Residential and Office District, to B -3, Highway and Arterial Business District, and upon passage of this
ordinance, zoning restrictions affecting R -5, Multiple - Residential and Office District, to B -3, Highway
and Arterial Business District, shall apply to said property:
A parcel of land located in the NW' /4 of Section 22, Township 20 South, Range 65 West of the 6 th P.M.
in the County of Pueblo and State of Colorado, and being more particularly described as follows:
Considering the North line of the NW' /4 of the NW' /4 of Section 22, Township 20 South, Range 65 West
of the 6 th P.M. to bear N. 88 0 42'57" E. and all bearing contained herein being relative thereto.
R -5 TO B -3
Commencing at the Northwest corner of said Section 22 said point also being on the Easterly right -of-
way line of Pueblo Boulevard (Colorado State Highway No. 45) as presently located; thence N.
88 0 42'57" E., along the North line of the NW' /4 of said Section 22, a distance of 897.93 feet to the Point
of Beginning; thence N. 88 0 42'57" E., continuing along the North line of the NW' /4 of said Section 22, a
distance of 402.01 feet; thence S. 01 E., a distance of 413.70 feet; thence S. 62 0 28'22" E., a
distance of 164.88 feet; thence S. 01 0 19'09" E., a distance of 162.66 feet to a point on the centerline of
31S Street as presently located; thence S. 88 0 40'51" W., along the centerline of said 31S Street, a
distance of 93.52 feet; thence N. 01 0 19'09" W., a distance of 40.00 feet; thence N. 28 0 10'45" W., a
distance of 49.39 feet; thence N. 50 0 41'25" W., a distance of 38.56 feet; thence N. 50 0 41'25" W., a
distance of 246.91 feet; thence N. 36 0 30'33" W., a distance of 272.82 feet; thence N. 19 0 49'12" W., a
distance of 172.13 feet to the Point of Beginning.
Containing 3.70 acres, more or less
and more commonly known as:
A portion of Park West Business Campus Filing #5, generally located near the intersection of
Spaulding Avenue and 31S Street.
SECTION 2.
This Ordinance shall be approved immediately upon final passage but shall not become
effective until final approval of S- 07 -02a, Park West Business Campus, Filing No. 5 Subdivision.

ISSUE
Shall City Council approve a request to rezone the property from R -5 Multiple -
Residential and Office District to B -3, Highway and Arterial Business District in
conjunction with a proposed change to a previously approved but unrecorded
subdivision?
RECOMMENDATION
The Planning and Zoning Commission, at their December 12, 2007 regular meeting,
voted 6 -0 to recommend approval conditionally upon the approval of S- 07 -02a, Park
West Business Campus, Filing No. 5.
BACKGROUND
This rezoning request is in conjunction with an application for an amendment to the
previously approved but unrecorded subdivision (S- 07 -02a). This subdivision
amendment proposes a change to a lot line that also served as the boundary between
the two zones of R -5 and B -3. These zones were previously approved for this
subdivision. Should the proposed change to the subdivision be approved, the zoning
would need to follow that new alignment.
